Ralph Volcere Served with Court Papers - Mathilda strikes again!

Ralph Volcere served with papers to appear in court on Monday morning. Mathilda Twomey strikes again!

Last Night Friday 9th December, two CID police officers came to my house at around 6.30pm. They served me with court papers to appear before the supreme court on Monday 12th December at 9am. The complaint against me was made on the same day by judge of the court of apeal in regards to the front page article in this week's Weekly issue. The speed at which the papers were drafted and filed and a court date identified and delivered at my house was simply out of the ordinary. If all court cases are address in this manner. There would be no criminal in Seychelles. This is a clear move to stop me from publishing articles about the shennanigans of the CA. On Monday they will issue me with a gagging order. I am appealling to everyone fighting for democracy, freedom and justice for Seychelles to come down to court on Monday just before 9am to show support for the cause. See you there... we have lost a battle but not the war. God Bless all freedom loving people wherever you are in the world. Peace and Love to you all!! RALPH VOLCERE

SOME IMMEDIATE REACTIONS OFF FACEBOOK (which might be banned soon by James Michel and his Communist Party Lepep):

Dear All. Ralph Volcere, Leader of NDP and Editor of Weekly was served with summons to appear in court on Monday 12th December at 9am to answer charges laid against him by Mathilda Thowmey. They want to stop him from writing on the shameful judgement of the Court of Appeal. We must all gather at the court from 8am to give Ralph our full support. We stand for freedom of expression and justice. Enough is enough!

    • Evelyne Honorez Wish I could come to support you, Ralph! This is terrible! Good luck to you and to the people of the Seychelles!

    • Jack Beck DECISION OF COURT OF APPEAL IN PDM CASE REWRITES THE CONSTITUTION

The decision of the Court of Appeal in the case of the Popular Democratic Movement is devoid of legal justification and totally ignores the key provisions of the Constitution regarding the matter of the case. In this decision, the Judges of the Court of Appeal, JJ Macgregor, Twomey and Fernando, have not interpreted the Constitution as it exists, they have written their own. These Judges have decided that the wording of the Constitutional amendment is not suitable and they have made their own amendment.

In its decision, delivered on December 9, 2011, the Court of Appeal found that the PDM was entitled to a proportionally elected seat in the National Assembly from the result of the general election held on October 1, 2011 because it had obtained over 10% of ‘valid votes’. It thus reversed the majority decision of the Constitutional Court given by CJ Egonda-Ntende and J Gaswaga and of the Seychelles Electoral Commission that the Constitution allocates proportionally elected seats on the basis of total ‘votes cast’ . The decisions of these institutions could have been overturned only with clear Constitutional basis which the Court of Appeal has not been able to provide.

The Constitution makes very clear and specific distinction between the allocation of seats to directly elected members and to proportionally elected members.

Article 78 of the Constitution states without ambiguity that the allocation of proportionally elected seats shall be as “specified in schedule 4”.

This Schedule 4 carries the clear tile “Proportionally Elected Members” and deals only with such members. Thus the Constitution clearly sets different rules for the allocation of these seats. The Judges of the Court of Appeal have no basis for saying that the two must be the same.

This Schedule 4 contains the provision that has been quoted so often and which was the basis of the Judgement of JJ Egonda-Ntende and Gaswaga of the Constitutional Court.

“A political party which has nominated one or more candidates in a general election and has polled in respect of the candidates in aggregates 10% or more of the votes cast at the election may nominate a proportionally elected member for each 10% of the vote polled. “

As the two judges of the Constitutional Court stated in their decision, the Constitution has in several instances used the terms ‘votes cast’ and ‘valid votes’ and it is clear that there are two different meanings. ‘Votes cast’ as stated in Schedule 4 is different from ‘valid votes’.

Votes cast can only mean votes that are put in the box. As CJ Egonda-Ntende stated, this is the only possible interpretation. The action of casting the vote comes before any interpretation of the vote as being valid or not. If a vote is invalid, it does not alter the fact that it has been cast.

CAJ Fernando’s statement argues that the Constitution could not have intended to recognise that a person would not vote or would cast an invalid vote. But this is precisely what Schedule 4 does.

The principle of using total ‘votes cast’ may be misguided. If this is so, then we have to go back and change the Constitution. The Judges have no right to ignore what the Constitution says.

The Judges of the Court of Appeal have fallen back, as Judge Burhan did in the Constitutional Court Case, on the Elections Act, which prescribes a different method of tallying the votes. But it is very clear that the Elections Act does not apply to Proportionally Elected Seats.

This is how the Elections Act begins:

Short title and Application 1. (1) This Act may be cited as the Elections Act.

      (2) This Act shall apply for the purposes of: -

      (a) an election of the President

      (b) an election of a directly elected member of the National Assembly

      (c) a referendum.

The Act does not include ‘Proportionally Elected Members’ in its stated purpose and makes no mention of proportionally elected seats. In seeking to rest their judgement on it, the Judges are grasping thin air.

The decision of the Court of Appeal, being so weak in legal justification, undermines the credibility of the Judiciary as the guardian of the Constitution and the law. The decision has grave consequences for our democratic system because it allows the composition of a National Assembly that is not according to the Constitution and by that sets aside the wishes of the electorate.

The Court of Appeal has, in this ill-considered decision, diminished the credibility of the Constitutional Court, of Chief Justice Egenda-Ntende and of the Seychelles Electoral Commission.

A large crowd are gathering at the Palais de Justice in Victoria in a show of support for The Weekly newspaper Editor.

Over 50 police officers have cordon off the court's building stopping the over 200 people from getting access to the compound.

The case is being heard before the Supreme Court judge Duncan Gaswaga.

Confusion that's all we see in SEYCHELLES politics, the oppositions are also responsible.
CROSSING THE FLOOR,SELL OUT,TRAITORS,JUDA ETC..
DP/SNP MARRYING AND DIVORCING,TAKING ONE ANOTHER TO COURT.REMEMBER F.ELIZABETH AND SNP IN THE NATIONAL ASSEMBLY.
J.MANCHANM national unity now no longer DP.SNP TRAITORS ANOTHER TROUBLE IN THE NATIONAL ASSEMBLY ETC,ETC,ETC...AND MANY MORE.The court has to deal with all these fiasco. Now D,PIERRE,R.VOLCER,M.TOMMY ETC..
COURT CASES,COURT CASES.POLITICAL BATTLE.
DP/SNP/SFP ARE VERY DIVIDED AMONG THEMSELF,THEIR UNITY DID NOT LAST LONG.
When they see oppositions in other countries win election or bring changes they become jealouse and say all kind of things but what they did not realise is that there's a big different between them and the other countries.
Too many strange things happen in our small SEYCHELLES.
People might be getting fed up with all these political court fiasco.

JEANNE D'ARC you might say its the same old tune but let me tell you its a very real fact that we are facing in SEYCHELLES,people only get confuse that's all.

Do not despair fellow Seselwa Rasin.

Everything we do, in however little way we do it, to expose the Pp Collaborator dictatorship is a victory. It brings us one step closer to taking our country back.

So when the Collaborators have to surround the Court with AK 47 armed men, it shows they have dwindling public support and a strong opposition they are afraid of. When you see events such as these, take photos of the event. Take videos of the event. Pass them along to Christopher or put them on -U-tube yourself. Inform us of its existence on the blog.

In these small ways we establish we are in control. They are then merely reactionaries. Chasing our shadows and living in their nightmare - our love of our freedom.

These grand shows of military force is a show of weakness as long as our spirits are unbroken. We will not be rid of the Pp Collaborator government in on fell swoop as many would like. It will take time and effort. That effort can be as little as just blogging your thoughts here. Even that small action irritates them because it shows the Collaborators we are free. There is nothing more they hate than our freedom because it threatens their power.

So do not despair. Instead decide what small step or instance of resistance you will do each day of every week. Through these small steps we will build our courage and lose our fear of the Collaborators.

When enough of us have no more fear of their guns we will get rid of them.

Asking about the crowd outside the court. The only thing that can be said it was a suceess in itself.WHY'Uaking in consideration of the time Mr.Volcere was presented with prostitute Mathilda court paper(6.30PM)and the imte Pierre^s took to figure out whatz he must do,contact his lawyer ,his party members to prepare his defence and the time he posted Mathilda intimdation paper on his Facebook to let us know what was going on,one can presumed it was already late in the evening thus to see more than hundreds freedom loving citizens coming down after they were called on to do so in limited time one can say it was a success. If you compare Volcere call for support and that to raM'S MONTHS PRIOR TO THEaSSEMBLY ELECETION calling on his supporters to rally into Sulivan's garden then only two hundreds turned uo thus Volcere definitely did better than RAM.

Since Mathilda actions was illegal and authoritarian and baiased she should give her demmission for she can no longer have the trsut of our citizens, she has also redicule the our justice system and that of Chief-judge Ntene proffessionalism she should be sacked to at least brushpaint a littel bit the tainted image of our justice system under Pp communist.

The time is 4.35 Seychelles time - the blogger last question about the situation, those who can/did get on the Court first floor can text, the very many on the road can take pictures and text.

There are 45,000 Seychellois out of Seychelles they could not be there and come to Seychelles.

"This is a time to leave nicecities aside, it was the exile/refugee who helpd that those business man set up the first Internet Service Provider in Seychelles, then sold to Cable and wire less.

It was the exile who encouraged, to Ari Tel to come to Seychelles - those same Seychellois Exile their ancestral "archaic, fraternal, iluminati, masonic - working and heritage" they contributed that the WWW set up. We could say a few more things.

In our work in Europe we have contributed to the setting up of OS Window, Yahoo, google and some of the Social Network.

Such discipline, expertise, knowledge is/are not meant to be abused. (to speak plain all those of you who are not of european roots - when the Italian mafia, family and other nations say you return a favour waht this implies - as such all those of you using the above system in place in Seychelles, to help, contribute, assist where you can by providing a few info of what the real situatioin is at the court and opn the Street - it this much) Even the Jamican mob and Yardies know of this golden rule. Yet not such info.

By the way if you are in such an utter mess, during the one party state the real individulas driving the undergroud in Seychelles, to prove it can publish a list of events 25/30 years ago. When you had the opportunity, those politicians who came along and worte their fax changed seychelles, the commonwealth changed seychelles and the exile who said they had changes seychelles. You beat a dog because you think he/it is not human - all of you in Seychelles are supposed human - certain discipline works and reacts in certain way when one refuse to listen and respond positively. We had also requested Mr Volcer daughter to ask for help to set up a Twitter account for this occiasion - we have not seen the result.

I/we have close contact to St Paul Occupy London, Finsbury Square and UBS building - we know how they work.

Where does that leave Govinden with his stupid legal arguments that all too often get accepted by compliant judges ?

He said that case had to be heard last Monday to restore confidence in the system, after serving papers on Volcere the previous Friday night.

He is right though that there is no confidence in the judicial system. He is in a good position to know the full reasons why, starting with corrupt judges handing down corrupt decisions.

PP marionette Mathilda wanted to intimidate Volcere ,pressure from the street has made her victim of her own crooked game and further epxose PP comunnist regime mal-practices.

Mathilda wanted to make Volcere a victim of political intringue and expendiency ,she has been defeated by her own game.

Govinden is the shadow of his own redicule,He is also the same guy who in the name of Pp allow Michel to sell out our patrimony to foreigners and who have in the past involved in questable deals inthe name of our people.Words coming from his mouth are meaningless ,we should not listen to such a donkey.

Before she left for Ireland to stuff herself with Christmas turkey, courtesy of a job from Parti Lepep, she wanted to put Pierre as Leader of Opposition and Volcere in jail.

She is leaving with her reputation in tatters as an incompetent and corrupt 19th century Dickensian beak after that PDM judgement and attempt to muzzle the independent press.

She will hang on to the job, as the alternative may be welfare in Ireland. But she has damaged the Court of Appeal. Given the sordid character she displayed last week and this week, I do not think she cares one bit as long as the money and patronage from Parti Lepep keep coming. And it will keep coming.

Foreign Affairs Minister Jean Paul Adam is now blaming translation difficulties for the gaffe that he made and raised concerns about China's military ambitions in the Indian Ocean. The story is refusing to go away in the international press.

Lost in translation is a poor excuse, for something that has exposed Adam as both naive and ignorant.

It is extraordinary that as Foreign Affairs Minister he did not know about China's policy of not having military bases abroad.

Presumably Adam is saying the Chinese translators mistranslated the discussion.

Adam was lying in another respect. He had been emphasising that Seychelles had INVITED China to set up a military presence. Whether it is military presence or just stopping for fuel and food, it is quite clear that China DEMANDED the facilities. Payback for the massive help given to Parti Lepep for their electoral campaigns.

More incompetence and lack of credibility at the heart of the Parti Lepep government.

It is right to say that Pp wanted to allow Chinese to operate without control in order EZZ.Considering the numbersand ranks of Chinese military official who were presents on the visits it is right to say that the Chinese wanted more than just helping us fight against piracy.

We must say no to any foreignewre peramanent base or present in our territories,it is more important to ensure that Chinese do not use our land and territories as a hubs for it own military objectives. As a small Nation our country should in any caes get invlove or particiapte in any super power military competitions or support one side or the other. You could imagine how disturbing the USA must be to read that Michel communist regime wants to allow Chinese operate freely eithout control in Indain Ocean thus near USA military base DIEGO GARCIA,it will makes USA venureablE.

Moreover ,we must oppose any such move becuase if we donot our couhtry will become a poetential military target of super power fighting among themselves. You could imagine should a war ignite betwwwen those two mamuths miltary mights how vunerable our country would be ,a little Nuclear bomb will make us vanish form this planet.

It is not strange to see and we should expect Pp communist poliemen use brutality even when there is not need for it ,they are badly trained, they donot have any ethic nor do they understand their duties. The use of Gas should the unproffesionalism of our institutions under Pp communists.

I give an example of how bad they are.I a modern and democratic country -Police officials are authorized to use force or their guns ,Gas sprays etc ONLY in self-defence thus if for instant their own lives or other citizens are in danger. For in a deomcracy if a police officer wrongly use his arms without any justification the police officer would be investigated and enventually be sentnce to jailed if find guilty ,or he could have used of means or if there were no necessitiy of ussing his arms. For instance,if a prisoner escape and not arms and is running away ,in Europe and other democratic countires in such a case the police offcier would need to run behind the person/thief wohever and arrest him not fire on him,WHY buecase the person in quetion did not put the lives of any officers in danger.

Under Pp police officers or GARDBU are trained to fire at will, they all have easy fingers of the tigger, they have been trained to kill rather than protect society.

So when you see Pp paid crimes dreesed in Police gards firing etc on their citizens please donot be shocked it is the way communist operates.

Moreover,in the same case or situation in a democratic country the police would have been there to not GASED citizens expressing their rights and freedom of expression and free speaches but rather would have given them secureity and ensure that the portests do not degenerate into violence for instant ,protect them and ensure that it does not disturb or impede those who are not aprticiapted BUT under communists they are send to brutalize thier own pople and abuse thier rights.

How low he has fallen down in the bottom of the gutter..no morals anymore!

By sending his armed thugs to police peaceful and unarmed protesters, Michel was playing with fire. He must know that the International Criminal Court is watching leaders who fire on unarmed and peaceful protests. If he sends them there with arms, he will be held responsible for their criminal actions under international law. Michel should remind himself what happened in Libya and to Saif Gadaffi.

Today, we have established our right to peaceful protests, despite the police threats made on SBC the night before. They were empty threats.

It is our constitutional right to protest peacefully without being harmed by agents of the state. We do not need anyone's permission. That principle was established today.

Michel's responsibility is to educate those that he sends to police peaceful protests, especially those that he sends armed to the teeth. He is dicing with international crime by sending armed thugs in uniforms to peaceful protests.

The police were quick to say there were no orders for "unauthorised" release of tear gas and they would investigate. They should investigate to deter future actions, otherwise they will be held accountable for condoning the criminal actions of their police officers.

At the International Criminal Court, Michel will be faced with real judges. There will be not a single judge of Mathilda Twomey's character and calibre on the bench of the International Criminal Court in the Hague, never mind the likes of MacGregor and Fernando.

Just goes to show that Mathilda Twomey's judgement was fixed. A decent judge with such family connections would have disqualified herself from hearing the case.

You are insulting/will ending up by insulting your own intelligence - this is not clever/wise or brilliant.

We must keep in mind that eacgh time Michel uses forces it is a sign of fear, and he is conscious that his rotten regime is in free fall and he won^t be able to change its course.Like Gahddahfi the more that he will see how his regime is fallling in to the bits^ch he would try to use agression to silence us.But the thing that Michel must keep in mind i that as Tunisia,Egypt and lYBIA IT WAS when police and armme started to use force to silent peaceful protesters that ignited the rapid fall of these regimes becuase when people who were not participating saw the brutalitely being exercise on their brothers and sisters they all decided to take into the strrets and the end result we all know.

Pp is afraid.Pp is frighten ;PP is loosing control ,PP is digging its own grave.so each time PP use force on you and with the pressure we inserting on him ;Pp would probably become more brutal ,keep in mind that it is a victory for us for it means Pp is about to collapse.

SEYCHELLOIS WE HAVING TH4R MOMENTUM.LET US KEEP IT .PP IS CRUMBLING -KEEP THE PRESSURE FOR PP IS GETTING OUT OF CONTROL-FREEDOM IS IN THE OFFING KEEP THE PRESSURE AND TOGETHER LET US FORCE PP TO CHANGE ITSELF OR WE WILL CHANGE ITHEM.

I would also take the opportunity to thanks all those brave seychellois who particicpated in this peaceful protest,it is showing Pp who long beleive that as long as we are not hungry,or else that we would not rise up:We sent the message in the lastelection by the suceesful boycott some pp ilks still don't beleive Seychellois are able and ready to rise up,we have proven to them that we are serious and will do what it takes to have back our country.

You all hoeros-keep the unity-
And lastly,as you have proven fear is for those who are hopeless not freedom loving people.

Mathilda wanted to aubse her position to intimidate opposition leaders but her action is having a reverse effect ,it is putting Pp regime under extra pressure which might results is a peoples' revoution.PP is scared that its thugs must go on SBC to excuse r themaselves publicly for the brutal action against protests.

Porbalby Pp and Mathilda are regretting their rogue action and praying that there is no more protest for each protest might be the lethal poison for PP.

FEAR rules us!

Until we realize that the only thing that we are fearful of is fear itself, we will always remain under the spell of fear.

Fear of God

Our religious belief is the biggest proponent of our fear! Until we can think freely without the fundamental tenet of our ideology (out of the box), we will forever be incarcerated in our very own essence.

A FREEDOM LOVING SESELWA

Fear is rooted by instinct...it goes back to the caveman days...survival mode kicks in when our lives are threathen.

However in this struggle for our rights and freedom fear should beleft for the hopeless.
Our outrage should be the emotion we feel or attempt to elicit instead of fear: I really think it shouod be the right attitude to have and should be the goal of all freedom loving Seychellois.

Lastly,i can asure you that though Michel and his cronies do not show their fears they are in fact dying of fear of a revolution that would bring their dictaotrship down ,so don't be more frighten than the Pp killers .

congratulations to all those of who turned up today...
I have it on good authority, that the BAS is actually embarrassed by what is happening, before, the corrupt judges were all under Rene, now, under the Michel regime, we have corrupt Seychelloise judges..
Mathllda was / is one of our own, and for that reason, its embarrassing for BAS.
We have the moral high ground..This is our land, Michel cannot tell us we cannot protest peacefully...It is US who´pays his salary for him and his corrupt cronies.
A change is gonna come...
first it was 100, today it was 200...soon it will be a thousand...
As jean paul has not yet writen the Human Rights report, and we have been without one for the last 18 years, i will take it on myself, to compile one, using the name of the all the people who were named as murdered on this blog, and sending it to Transparency Interenational, Amnesty Internnational, the UN, Red Cross and any interested agencies...
we cannot accept Today in Seychelles also to be impartial...the editor and mathilda are very close...or maybe nicole is embarrassed also ?

I hope protitute Mathilda has learned her lesson namely that this genration of Seychellois is not afraid and won^t let a gang of crooks intimidate them .

MAthilda objective was to silent us instead she almost ignited the begging of a people' revolution,With fear in their assholes PP rushed to SBc to excuse for the deliberate use of teargas of protesters and even publicly asking for an investigation.Amazing isn^t it?That PP for the first time in thierty-three years of dictaotrship went public to excuse themselves.Michel is surely loosing xcontrol and thevfear has instalt firmly in his old ass.

The oppposition can only benefit from that and all signs indicate that we making progress, thus keep the pressure.

For the fool who is blaming Today nespaper and its editor, get your facts right. At least Today put Ralph on the front page and also put an article on Gerard Hoarau a few weeks back. Stop blaming the one paper who at least has the courage to publish cartoons about the voting issue and votes cast. If you are too stupid to understand, then continue to buy a Nation to please Michel, People to please Michel or Rising Sun to please Michel and Ramados. I also know the Editor Mrs. Nicole Tirant and she is a pillar of strength and a person who would never compromise her stance on democracy. Matilda cannot hold a candle to Tirant who has fought Rene and Michel in her time, let alone that fucking Indian Ramadas. Matilda is simply a whore who has sold her soul to Michel out of desperation and can no longer see right from wrong due to the fat Euro cheque she gets every month. We need to support Weekly, Today, Hebdo and any other independent newspapers as they are published by heroes who believe in freedom and democracy for seselwa. So fuck off if you think that Tirant and Today are sell-outs. At least Today's journalists were at the court house today taking pictures. Where were you?

Rhonda, I totally agree with you that Nichole is a great Seychelloise and is doing a wonderful job at Today despite the Party Lepep wolves at her throat.

People love to criticise but they have no idea what it is like to run a newspaper in seychelles. Does anyone remember Life? It was shut down by Albert Rene. Apart from Regar which is now history, can you call SBC, Nation, Rising Sun, People and Isola Bela a free press? So people, think before you criticise and place the blame of the Volcere fiasco where it belongs: Mathilda and MacGregor as they have sold their souls to the devil.

Nichole is fighting for democracy and hopefully she will win. So please support Weekly, Today and Hebhdo as they are truly the only hope we have of a free press in Seychelles. Of course if you prefer James Michel's mouthpieces, i.e. SBC and Nation, then by all means pitch a tent at State House and start sucking like Mathilda and all the other female prostitutes who reside within the communist State House fences. Long live democracy and long live freedom of press and freedom of expression.

It was a time that SNP arise and J.MANCHAM NATIONAL RECONCILIATION brought more damaged to DP PARTY at that time.
SNP PARTY was very, very actived many people had beleived that SPPF/PARTI LEPEP was going to finish ended, while at the same time DP PARTY was fighting to stayed alived.SNP talk alot about the DP PARTY FIASCO at that time because they were the best.Winning larged in election.

It was another fiasco in the national assembly,C.GILL crossing the floor in the national assembly might had left it's marked and the SNP MEMEBERS at that time was very cautious because it was something that must never happen in their party.

In 2011 SNP THE BEST POLITICAL PARTY IN SEYCHELLES faced the worst humiliation more devasting than what DP PARTY had gone through.SNP PARTY SUPPORTERS HAD NEVER DREAM OF SUCH DISASTER and all the things that are happening in court recently its the impact.Again in the national assembly J.CARPIN action had been the worst.

Again for unity reason SNP/DP join together now R.VOLCER is helping W.RAMKALAWAN because the damage is too big many SNP SUPPORTS left some has even believe that W.RAMKALAWAN should resign just like J.MANCHAM in DP PARTY DID but in the REFORMED SNP W.RAMKALAWAN had vowed that this will never, never and never happen again.

The court get busy with all these political fiasco.C.GILL I believe SNP/DP UNITIED are trying to win people heart again because R.VOLCER no longer see voting for SNP mean voting PARTI LEPEP,OPPOSITIONS PARTY are falling in deep shift so now they all have to work very hard.WHY ARE YOU NOT IN THE TEAM,IT SEEM YOU WERE NOT IN COURT YESTERDAY?W.RAMKALAWAN WAS THERE BUT NOT YOU.

For the ignoble judge in Ireland, now that money is no object, the price of turkey this Christmas is neither here nor there. After her excesses in the Court of Appeal, she should devour the turkey with care in case there is divine retribution after the sumptuous, principles-free Christmas meal that she can now afford. She should also spare a thought for those still on welfare this Christmas but still have a clear conscience. If she is tempted to toast her new fortunes, she should avoid such grossness. No toast to cronyism and nepotism leading to corruption, please.

I am not convinced that Today is an independent-minded newspaper. I believe there is a lot of self-censorship at best. I buy Today based on what is on the front page. Otherwise my ten rupees stay in my pocket. If the front page is not interesting, all too often it is not, the rest of the paper isn't. There is hardly any investigative journalism which would set Today apart from Nation and Rising Sun, but of course would annoy Parti Lepep.

As I said before, the piece on Gerard Hoarau's anniversary was unexpected and it was buried deep inside Today. Its place should have been somewhere on the front page. At least it should have started on the front page, to give the anniversary the prominence that it deserved. I can't remember what boring, stale 'news' was splashed across the front page but that day Today missed an opportunity to show that its newsworthiness sense will not be cowed by the threats of State censorship. Let's recall that the piece on Albert Rene, full of tendentious opinions it was, was put on the front page and not in the obituary section.

China plans Seychelles naval base
Beijing
December 15, 2011

China wants to establish a post in Seychelles to supply its anti-piracy patrols in the Gulf of Aden. Photo: Reuters
CHINA is weighing up whether to open an Indian Ocean naval base in the Seychelles, a move likely to heighten tensions with India amid fears of a regional arms race.

Beijing's defence ministry has confirmed it is considering an offer from the Seychelles government to establish a port to supply its anti-piracy patrols in the Gulf of Aden. But the move was greeted with concern in India, as it announced increased military spending to strengthen its long border with China.

Delhi will spend more than $A100 billion on arms in the next five years to strengthen its eastern and western defences against China and Pakistan.

Vikram Sood, India's former intelligence chief, said he was surprised that the Seychelles, traditionally close to India, had offered naval facilities to China.

I was at the courthouse yesterday to show my support for Volcere and there was nearly a riot when we were banned from entering the place.

I just read the Nation and Today in Seychelles newspapers at my office. I cannot personaly afford to buy the papers but our company has a subscription.

Today's headlines reads "Police swarm Supreme court premises" and "public kept at bay" and the paper has dedicated its entire front page to Ralph Volcere's case. The article aslo mentions that a foreegn reporter was allowed in court yesterday while Today's own journalists were barred from the proceedings. i was there and can agree that the police had guns and were confrontational. Maybe next time I will bring my catapult and some small rocks to protect myself in case these police who are acting on James Michel's orders try to shoot us.

The headline from the state-house controlled publication Nation reads "Stricter law proposed to boost road safety" and only mentions Volcere has plead guilty on the second page.

It is clear that the Nation is being gagged and also SBC. We will only see justice in Seychelles when SBC and Nation have been buried into communist graves. As long as James Michel is the Minister of Information, the Seychellois public will continue to be bombarded with shit every day on Nation and every night on Onezime SBC chanel while the real news is buried so that the population are kept in the dark. They want us to remain illiterate couyons.

I call on all Seychellois men and women to support Ralph Volcere, Gervais Henry, Marc Houareau, Jean-Francois Ferari, Christopher Gill, and all others who have the courage to publish a newspaper in Seychelles. These heroes are putting their necks on the line to bring about democracy and freedom of press and expression to our country. We cannot let James Michel treat us like couyons and we cannot let the justice department continue to be corrupt.

Volcere has pleaded not guilty. Twomey looks guilty.

Leonard Francis Gill said...

Many of us feel disappointed by Matilda Twomey's participation in authoring the Court of of Appeals Opinion that has so blatantly betrayed our democratic aspirations. We had believed that she especially of the 3 judges, would protect and promote our liberty and, in the end, we believed she would defend it at all costs. She did not.

Given her previous steadfast principles favoring liberty our deep disappointment is justified.

If she took a bribe for her opinion in order to mitigate her personal economic hardships as some have speculated, then we are doubly justified in vilifying her. But, in the end, let's keep the focus of our anger where it justifiably belongs - squarely against the Pp Collaborator government.

If Twomey took a bribe as some have alleged, then ask yourself why she was chosen to be bribed by the Pp Collaborators. I submit that she was targeted precisely because the Pp Collaborators knew we trusted her and would direct our rage at her instead of them for the recent Opinion.

This is consistent with rene the Butcher's strategy of dividing us in order to conquer and rule us. He and his co-conspirators have taken relish in dividing us Rasin between ti nwar, malbar, grand blanc and so on to intentionally divide us. They are doing it again.

So when you direct your rage at Matilde, though justifiably so, rene the Butcher and Michel the Collaborator are laughing. It was what they intended you to do.

This is the same kind of perverse enjoyment that sadistic Nazi concentration camp guards had when throwing scraps of food into a train cattle car full of starving human beings, only to watch them claw each other to death in order to eat a few scraps in order to survive.

In that sense Maltide is a victim as well; though not a sympathetic one. She was targeted by the Pp and systematically pulled down with the full power of the resources held by the Pp Collaborators who skillfully exploited her weaknesses that they carefully mapped.

This can be seen in many other circumstances in our motherland as well. For instance the same can be said of the young Seselwa men and women who wear our country's uniform with the intent of defending the country only to be used against their own people. They do not want to direct guns at their own people - many have little choice, so many will join us when the time is right as we have seen in many other countries.

So, in a sense, we are all victims of rene the Butcher's legacy of dividing us. The Collaborators have perfected the art of seeking the weakest amongst us in order to perpetuate this division so they can impose and perpetuate their dictatorship.

So let me suggest that we victims should not fight each other. We should not hate each other. We should direct our rage at the truly guilty - the Pp Collaborator government.

The Pp Collaborators are the true culprits for forcing many good intentioned Seselwa Rasin to sell their dignity for a few pieces of silver, or to obtain an education, or to advance professionally or socially. No government should use its power, and the resources of its people, to do that to its own people.

This is what we should direct our anger and efforts to correct.

With Twomey in court, Gaswaga says he is there to judge the case on the "evidence and the law".

Touché, Twomey.

When Twomey overturned the decision of the constitutional court (which included Gaswaga), she certainly did not do that. Maybe she will learn more about the law by spending 5 days in court while she tries to jail her critics following that disgraceful judgement.

Still the speed with which this case is being dealt with tells me that this is retribution not justice. There must have been collusion between Parti Lepep, Attorney General's office and the Judiciary. No one really accepts Govinden's bull about "restoring public confidence in the judiciary". He is saying that there will be no public confidence in the judiciary unless Volcere is jailed !!!

The other cases before the courts are proceeding at the customary snail's pace. And that gives the public massive confidence in the judicial process. And so does Govinden's incompetence it would seem.

Police spokesman, Toussaint, says the release of tear gas did not cause a lot of damage. It was quite clearly deliberate and perhaps intended to create public disorder by the very people who were sent there with all their riot paraphernalia to keep "order". That's very serious. Just as serious as the brother of disgraced judge Twomey trying to provoke protesters. Being still drunk is no excuse.

What's serious to them ? Are they waiting for one of them to fire on protesters and then claim no orders were given.

Michel should keep his riot police in barracks, if he wants to avoid being arraigned before the International Criminal Court like Saif Gadaffi. If he sends his riot police to face peaceful protesters, he is responsible for their actions.

Here is another reason why we need RALPH VOLCERE free. He is an advocate of an independent and reputable Court of Appeal and they are trying to silence him.

JUDGE DOMAH MUST DO THE HONOURABLE THING

After the Bar Association contested the re-appointment of Justice Matadeen and Judge Judhoo in 2004 and 2005 respectively, they both resigned their offices as per their attached letters of resignation.

However, Justice Domah has refused to resign and has appointed Kieran Shah to represent him to contest the petition of Viral Dhanjee. Despite the petition to annul his reappointment, he remains determined to remain as justice of appeal and is currently sitting as a justice of appeal at this session. But this session started without the traditional speech of the President of the Court of Appeal possibly because the Court of Appeal is embarrassed by Justice Domah's action by applying for a second mandate in contravention of the constitution, which was described at the hearing of the petition as unethical for a Judge to do in our democracy. Roll Call finished within a record time of less than 30 minutes on Monday.

Justice Ramodibedi and Matadeen and Judge Judhoo refused to sit until the competent court finally disposes of the petition challenging their re-appointment.

The Constitutional Court has made it clear that, if they hold that Justice Domah's re-appointment is null and void, he will be deemed to have never been re-appointed as a Justice of Appeal. Does Justice Domah realise the financial strain that he is placing on our country ? Furthermore, if there is an appeal against the judgement of the Constitutional Court, it is unlikely that his brethren on the Court of Appeal will be entitled to sit on the appeal, specially President MacGregor who seconded his re-appointment in a letter to the CAA. If his colleagues do sit, justice will not be seen to be done and Court of Appeal President MacGregor will be a judge in his own cause -- as the famous Latin maxim goes, "nemo rex in causa sua". This will cause mpre financial strain on our economy as we will have to appoint an ad hoc Court of Appeal, as was appointed to hear the case of Bar Association v/s Rabodibedi, Matadeen & Judhoo.

Domah must do the honourable thing and resign before any further damage is done to the reputation of the judiciary.

Reply to Critics of Seychelles Today-

Today newspaper plays the role it was intended to: an independent newspaper that offers Seychelles a daily voice.

I cannot forget ever the feeling I had the day my garage was burnt down. Not one press called me. Not one single newspaper wanted or cared about the story.

The exception of course, was Seychelles Today.

They covered a front page color shot of the burning structure intended to foment fear and intimidation in silence and left to the be unknown to the world.

Ralph Volcere case was front page covered this week, thanks to Seychelles Today.

I personally stand and defend Seychelles Today for their independence. I thank their team for the good and hard work they do every day.

The critic may want to add a voice to the crowd and start a paper to complement the effort of removing the communists from their thrown.

Leonard I want to add one more line to your comment regarding Rene divide and rule policy. Back in the 80's Rene placed a staunch supporter of Mancham, I won't mention his name, at the housing department to fulfil his empty promises of providing houses to Seychellois. There were not enough money and resources for such a project and he picked that guy on purpose so that people will turn against him when they were not getting a house. When people go to see Rene for their housing problem he will place a call to this guy right infront of you asking this fellow why so and so has not got a house up till now. After he hang up the phone he will tell you to call this guy and he has already rectify all the issues that was holding up your loan approval. After you leave his office he will tell those around him "this is how I screw all Mancham die-hard supporters"

David Pierre nominated himself and voted himself leader of the opposition today. To get some credibility for his new title, he has called for meetings with James Michel. He forgets he represents just 7.7% of votes cast, and that must include Parti Lepep supporters instructed to vote for PDM.

Meanwhile, in her welcome speech, Leader of Government Business, Potter, has acknowledged that the real opposition is outside the national assembly.

For the first time, the speaker of the National Assembly has appointed his "leader of the opposition" as the chairman of the Public Accounts Committee. In the past the post was reserved for Parti Lepep. You can tell David Pierre is one of them and they are not afraid of him. You can also tell that Parti Lepep is fighting the real opposition outside the national assembly.

Presumably, the Central Committee of Parti Lepep is also guilty of contempt of court as they discussed the court case and expressed their preferred outcome.

Doesn't Mathilda Twomey think that was an attempt to sway her judgement ? It is quite telling if she does not think so.

Even if the Weekly article was published on Wednesday night, as Today in Seychelles 'helpfully' points out, and not on Friday morning, it must be remembered that Thursday was a public holiday. Is Twomey really telling us that she read the Weekly before the judgement on Friday morning ? Did she really spend the public holiday reading Weekly ?

Also, MacGregor was aware of Twomey's judgement for him to "concur" on Friday morning. This would indicate that, as we suspect, the decision was stitched up days before it was delivered. By the time, Twomey saw Weekly the decision would have been typed and cast in stone.

Is this really a case of contempt of court or that of an judge who has given a decision that many see as corrupt out for retribution because certain facts about her have been made public which put her in a different light from now on ? This is really about gagging the press and wanton abuse of power, so that information that shows judges have vested interests and should recuse themselves in some cases is never made public.

Mathilda Twomey should have recused herself. Her decision is tainted because her close brother has close connections with James Michel and Parti Lepep. By failing to recuse herself, she brought the Court of Appeal into disrepute and damaged public confidence in the judicial process. Having failed to deliver justice in the PDM case and having given us a stooge as leader of opposition in the national assembly, she now wants the Supreme Court to deliver a miscarriage of justice. She is like a bull in a china shop and is inflicting more damage on our fragile institutions. She deserves our total, unbridled and justified contempt.

This is a case of someone who thinks she has been "libelled" but prefers to abuse her position to bring contempt of court charges. That's contemptible !

Some previous blogers have been alluding to a sort of plot organised and executed by albert Rene to get Michel out.
My 7 year old son no longer believes in Father Christmas. DO YOU??????

Assumptions and allegations that Rene is still pulling strings and Michel is not his own man is a whole load of bullshit.Warm, moist bullshit.

Rene has been sidelined ages ago. Michel will hand over the presidency to whoever he wants when HE decides.
It may be to Danny Faure but it could also be to Jean Paul Adam.
As simple as that.

Now it should be known that Michel did direct - directly or indirectly- the court of appeal to overturn the constitutional court's decision.

Marie Louise Potter referring to opposition outside the assembly?
Another window-dressing exercise.

Anonymous said...

Potter thinks when she said that real opposition are outside the opposition will praise her for that and maybe even accept Pierre illegal present in the Assembly as if nothing is wrong about that.Potter herself is holding a position in governemnt that was created only for her by Michel also unconsitutional,so maybe we wants us to forget that She is also fake like Pierre.

To Anonymous (5:53pm) above (Who sounds like TIKLO, Proxy for rene the Butcher):

You are right Proxy. We do not have respect for past Presidents who have stolen power by the barrel of guns of foreigners then systematically proceeded to sell out our patrimony to fill their own pockets, as the rene the Butcher has done.

We do not respect anyone who Butchers his own people just to keep political power to fill his own pockets, as rene the Butcher has done.

In short we respect no one, I repeat NO ONE, who abuses our liberty and compromises our freedoms and dignity.

None of our Presidents to date have been elected in free, fair, transparent democratic elections. For instance, the recent Presidential election qualifies as a comedy if it did not have such a tragic impact on we Seselwa Rasin.

After the Pp Collaborators blocked access by the opposition to radio and television. After they blocked public access to the voter registration roll. After they blocked public access to a list of the number of passports they have sold to create Fabrike citizens to vote for them. After they they created these favorable conditions to stack our electoral roles with fraudulent voters. After they burn down opposition property. After they shoot at opposition leaders cars and on and on, they held an election.

You want me to respect "election" results from such a farce? You are thicker than I thought.

When we have a President who is freely, fairly and transparently elected by a majority of all us Seselwa Rasin to be the trustee and guardian of Seychelles our motherland, for the benefit of all Seselwa Rasin, then he or she will have not only my respect but my allegiance - whether I voted for her or not.

You want my respect and that of all Seselwa Rasin - earn it! You cannot demand it and you will not get it by putting a crown on your head backed by murder, torture, lies and deceit.

And Proxy we know exactly what we are looking for. First we want a decent and honorable government who does not murder, torture, burn its citizens property, shoot at its own unarmed citizens. Basically, we want a government that does not engage in state terrorism against its own citizens just to stay in power. Secondly, we want genuine democracy where elections are transparent, free and fair. That means all opposition candidates must have equal access to public media like, radio, television and other means of communicating with the Seselwa Rasin public. Thirdly, we want a government which respects our right to freely associate and assemble to air our grievances without petty restrictions and without intimidation by hundreds of armed AK47 carrying soldiers. We want elections held pursuant to a public electoral registry where only Seselwa Rasin should vote - we don't want our elections decided by Fabrike who claim their citizenship because they bribed Pp officials to sell it to them. We want a government that does not sell out our patrimony to Fabrike and foreigners for ten rupees and millions of Euros in bribes per instance. I can go on and on here TIKLO.

So yes. We know exactly what we want. We will get it. We also know it cannot be found in the Pp Collaborator ranks.

So with his massive 7% of the votes,David Pierre has, as expected, waltzed into the national assembly and suddenly everything is possible. He will chair the Public Accounts Committee and will soon be appointed on other committees.

His call to meet with Michel is a well-orchestrated dance.
Michel would want to congratulate him for the breath of fresh air he brings to politics.

Ramka is further sidelined and there is no hope in hell for him to make a comeback. Why he insists on hanging on to the leadership of SNP beats me.
More than just being hard-headed, the party today needs a clear strategy on the way forward. Only a fresh dynamic leadership can do that.

Thank you very much for your anecdote or story about rene the Butcher and Mancham's housing officer.

These anecdotes show us exactly what kind of human being we are dealing with when we are discussing rene the Butcher. While most Seselwa Rasin over 50 know exactly who he is, the Butcher has tried to put on a different face for the younger generation and for his international image. We need to establish a permanent electronic record of the Butcher really is.

We need to show the truth of his efforts to divide us Seselwa Rasin by use of deceit and devious means of all kinds all to advance his own personal ambitions. We need to show how he acted only in his personal interests, while pretending to act in ours. We need to show that whenever he did something for someone else it was only to bolster his dictatorship. We need to show establish truth of who he is.

So whatever stories you have about rene the Butcher that you personally witnessed, post it here. We Seselwa Rasin need to know and the world needs to know who the Butcher is. Who the Butcher is, is exactly what the Pp Collaborators ruling us now are.

Reply to Jeanne D'Arc Comment-

You are spot on again on the Volcere Court case.

It is politically motivated as rightfully pointed out and it was being used to deter attention and energy from the real issue: PL Communists obstruction of the will of the voters that BOYCOTTED the election and those that stayed home to not give Pierre Spongebob Party 10%.

PL Communists, through under handed manipulation of the Court of Appeals gave the Spongebob Party 10% and the perks that go with it, not the people.

What exposes this falsehood is the PL refusal to take 2 more seats Gappy has assigned to them in order to assign one (1) seat to Spongebob.

At Court, the presence of army soldiers (under command of the Commander in Chief for now, James Michel) , State House Agents from the (Executive Branch), Police and SSU under control of Internal Affairs in a pre emptive affront to block access of the Public, to a court proceeding is an obstruction of respect for democratic principles of separation of powers and respect for the rights of the Citizen.

The moves by Michel and his boss Rene to date, have destroyed the Constitution of Seychelles under the 3rd Republic.

We must all call for new constitution and a referendum to be approved by the people of Seychelles.

All articles and all laws of Seychelles need to be Stress Test for best democratic practice standards. We must accept nothing less then this as a People.

The opposition in spite of its internal squabbles and in spite of DP SNP being historically financed by PL Communists and their agents like Ambassador at Large Siva a (Fabrike), must meet with SFP to set the agenda for change to move forward as a united front.

Another favour from Parti Lepep to David Pierre. He was sworn in quickly on the last day before recess. Otherwise he would have had to wait a few weeks. Parti Lepep couldn't wait to appoint their own leader of opposition.

As we saw with Mathilda Twomey, you can't take favours from Parti Lepep and be independent. I don't suppose such ethics and principles matter to either of them.

Meanwhile Mr 7% has called on James Michel to have talks with him on behalf of the opposition.

David Pierre will always be a stooge leader of the opposition IN THE NATIONAL ASSEMBLY, while the real opposition are outside the national assembly fighting for democracy.

His party was registered in haste by the Electoral Commission so that he could undermine the boycott of the elections by the opposition.

He did not get 10% of votes cast, even the compliant Electoral Commission realised that. He had to rely on a corrupt Court of Appeal to rewrite the constitution.

It is true that Parti Lepep swore him in very quickly. The national assembly is still dysfunctional and a one-party national assembly, without an opposition voice. No wonder Herminie looked pleased. He does not have an opposition to contend with in the national assembly.

All these electoral and judicial chicanery does nothing for the image of our country. But who cares ?

They will jail Ralph Volcere. Can we expect any other judgment from the judiciary in Seychelles ? Gaswaga says he is there to do "justice based on the evidence and the law". That was more a dig at so-called justice Twomey than a statement of fact. We brace ourselves for more ignominy to be heaped on the court by judges and justices, while they call for public confidence to be restored in the judicial process.

After what I've heard about so-called justiceTwomey, I would not be suprised if she goes to lie in court about the impact the article in Seychelles Weekly had on her decision. Like Alain St Ange, she seems to think she has to go over the top to convince Parti Lepep of her absolute support in order to protect her position, salary and perks. Michel has well and truly corrupted the fabric of this nation, while in turn calling for social renaissance. Can't they tell that these actions day in day out are incompatiible with social or moral renaissance. As we saw in the national assembly yesterday, the message we get everyday is that treachery and sordid behaviour pay and pay handsomely. Meanwhile, Nichole Tirant-Ghérardi too should be prepared to go to jail in defence of freedom of expression to expose wrongdoings in the country.

Rampant corruption at all level Seychelles Justice System.
The justice system has groaned and sunk under the weight of disputes by the citizen of Seychelles. It is overloaded, despite CJ announcement to fix it things remain the same. It is inefficient, untimely and it is unfortunately whether we say or not permeated at all level of corruption. Some of the corrupt practices are concentrated at the registries of the court. Files disappear through influence of lawyers, organised crime has taken over the system. The drug lord are running it with the help of some powerful lawyers, and corrupt magistrate, judges court Clark etc.
Mr CJ do your work do not sit on your fat salary enjoying cocktails, party's, overseas trips while criminals are running your court. Wake up and do something for us citizen of Seychelles who are paying for your fat salary. If you cannot do the job then pack up and go back to Uganda. Seychelles deserve better. Mathilda Twomey It is tough Denis but let me tell you that with my Irish passport which I have tried using instead of my Seychellois passport on such visits I do not get any better treatment. Just had frustrating time at Gatwick coming from Bordeaux (with EU passport mind you) because at Immigration desk I did not have my boarding pass - I mean the one I used to board the plane from Bordeaux to Gatwick. I had destroyed the boarding pass once I was on the plane. In vain did I try to point out to the official that it was a boarding pass not a disembarkation card! and he could see I was with other people who got off the same plane and I had not landed from Mars. I had to go to an office and be interviewed and get an official form stamped by yet another official. And that was in the EU where there is supposed to be free travel!!!

The wretched Parti Lepep judge has been complaining about lack of preferential treatment in UK as she goes through the airport on her globe-trotting.

She better realise that in the UK, judges do not seek, get or expect preferential treatment from the state that would undermine their need to show that they are independent judges.

When she enters Seychelles to sit on the Court of Appeal, she gets VIP treatment from the state.

Such behaviour at foreign airports lacks decorum for a judge.

The errant judge thinks British immigration law should be waived for her and she should sail through immigration. She gets a lesson in abiding by the law from an immigration officer working without fear or favour and she goes on Facebook to complain, never mind that Parti Lepep wants to ban discussions on Facebook. It is not just the difference between total votes cast and total valid votes cast that she does not know. She obviously has big problems to sort out. St Ange, Twomey, Carpin and Pierre -- the villains of the year.

Looking at Herminie's face last night, it was obvious he knew he was swearing one of the additional seats the Court of Appeal gave to Parti Lepep. He was not that pleased to see Pierre the last time he was in the national assembly. Pierre says he does not believe in single party politics. Even on his big day, he still has to justify to himself why he betrayed the opposition and took part in the national assembly elections.

Whilst not wishing to get Le Seychellois Hebdo into trouble, the paper wrote about the case a week before Seychelles Weekly. The difference between the two articles was that Weekly gave information about Mathilda Twomey which annoyed the woman.

PARTI LEPEP WANTS PDM TO WIN APPEAL

Le Seychellois Hebdo has learned that the Popular Democratic Movement's case before the Court of Appeal was on the agenda of the last meeting of Central Committee of Parti Lepep (PL).

The CC members expressed their wish that PDM would win the case. If this is so, not only will PL be allowed two more proportionally elected members, but most importantly, the presence of PDM in the National Assembly will establish a two-party Assembly with an official opposition including Leader of the Opposition.

Whatever the interests of the ruling party, there must be no attempt to return to the days of the past with attempts to influence the Judiciary, simply by making the wishes of the Executive known.

The Parti Lepep and the Executive are desperate to see PDM win, to try and give Seychelles' democracy some credibility in the international community after the successful boycott campaign in the October election. The recent re-election of Wavel Ramkalawan as Leader of the Seychelles National Party Leader has led to nervousness in the camp of the ruling Parti Lepep.

They are hoping that the appointment of David Pierre as Leader of the Opposition will significantly reduce the importance of Mr Ramkalawan on the national political scene. With the presence of a one member opposition in the National Assembly, Parti Lepep will also be spared from the mounting pressure to have fresh parliamentary elections once the electoral reform process is over.

Should the Court of Appeal reverse the decision, this will be a serious blow for the Supreme Court, especially for Chief Justice Egonda-Ntende. It will mean also that the Electoral Commission would have failed in its first task. Should this be the case, the public will expect nothing, but the resignation of the entire Commission.

Interestingly it was Justice MacGregor who was the National Assembly speaker when the Constitution was amended in 1996, which brought in the 10 percent rule.

It should be noted that in his judgment, Chief Justice Egonda-Ntende noted that: "Had the legislature intended that the threshold be 10% of the valid votes, it would have said so exactly. It was familiar with the expression."

The public is expecting the highest Court in the land to be impartial in its judgment and any attempt to try and influence court's judgment will be met by a public outcry, as the Judiciary appears to be the last branch of government which is yet to be compromised.

Still no news of the promised enquiry into the police thug who released tear gas into the crowd last Wednesday. It sounds like he was operating under orders to instigate a riot. Still if they do have an"independent enquiry" it will probably be done by that woman Twomey and her drunk brother in order to further incense the opposition. They will probably say it was a water pistol and not a tear gas canister. Twomey will then fly out to Ireland first class on Etihad Airways courtesy of Parti Lepep, daring any editor of the free press to expose her new dolce vita since she was saved from the unemployment queue in Ireland. Did Judge Gaswaga really say in front of Mathilda Twomey in court that he was there to give justice according to the law and the evidence ? He might well have added -- unlike you, Mathilda Twomey. Meanwhile David Pierre's presence in the national assembly inflicted more psychological and moral damage on the nation, when he nominated and appointed himself leader of the opposition. Nice work if you can find it. As the speaker was in hurry to swear in David Pierre before the end of the year, the mind-blowing spectacle was a fitting climax to the year of social renaissance. Kok Maron is back in the national assembly. Potter and others can't hide their pleasure and have already started blowing the self-styled leader of the oppositon's trumpet.

Marie-Louise Potter is the Leader of Government Business in the national assembly. This post does not exist in the constitution. It has been invented by Parti Lepep. With Parti Lepep's electoral shenanigans, we now have a dysfunctional leader of the opposition in the national assembly. When Parti Lepep MNAs look to the left and see Potter and then look to the right and see Pierre, do they not ask themselves what are they doing in this circus ?

Air Seychelles Stop flying to Europe.
My fellow country men/women your now in the mercy of the Arabs.Tourist will not fly to Seychelles from Europe, and make a stop over to Dubai no they are afraid of them. My experience few years ago after taking
a flight from Paris transited to Doha for Seychelles, I had a nightmare about this journey. Doha Airport Terminal toilets are dirty, you could see those Arabs in their white dress without underwear, penis hanging and washing their ass with a water pipe with 'caca' on the floor everywhere. They do not use toilet paper. I was treated like a dog, they only wanted my passport something which I failed to hand over until my departure from there. I told myself I would never ever transit to that country again, Was I wrong ?. I am now being forced to go back there because of Francis Savy mismanagement of Air Seychelles and the Seychelles Gov concessions, making stupid decisions, giving the tourism business to the Arabs namely Kalifa.
James Michel shame on you for selling our country to the Arabs.

I think most people watching proceedings in the national assembly last Thursday would have found the whole thing unreal. Pierre nominating and then electing himself, by his own single vote, leader of the opposition. He said: "I nominate myself Mr David Pierre". Even speaker Herminie felt he had to explain this bizarre event to a disbelieving nation. Pierre raising his hand to appoint himself leader of the opposition by his solitary vote reminds us of Jane Carpin raising her own hand to vote with Parti Lepep while pretenting to be in the opposition. Parti Lepep even suspended standing orders to allow Pierre to attend Michel's state of the nation address as leader of the opposition in January. Not something they would have done for a real leader of the opposition. Presumably they have worked out that Pierre has enough reasons to be grateful to Parti Lepep not to call Michel a coward to his face again. That's what happens when the ruling party goes out of its way to annihilate the opposition. They end up with a fake one. One or two PL MNAs started to clap Pierre's self-declaration as leader of the opposition but then they thought better of it and the cheering petered out. They must wonder when they look at Pierre whether he is the real thing or just an impostor. After all, they know that Parti Lepep told some of its supporters to vote for PDM. Pierre still failed to get 10% of all the people who went to vote that day. He had to rely on Mathilda Twomey's legal gymnastics and pretence that 15,000 who went to vote and spoilt their vote did not actually go to vote. In the process, she split her tutu and is taking out her frustrations on an editor of the non-Parti Lepep press.

Pierre is not the leader of the opposition. He is a maverick and a demagogue. He is a Parti Lepep creation designed to undermine the opposition in the country. While Parti Lepep gets a semblance of democracy in the national assembly, Pierre will start to rake in more money. It is a win-win situation for Parti Lepep and Pierre and they are living off each other.

Events since the boycotted national assembly elections show us that Wavel Ramkalawan has taught Parti Lepep the need to show respect to the opposition and democracy. Parti Lepep has been mentally deranged by the absence of the opposition in the national assembly. It is doubtful whether last Thursday's spectacle will change that. Pierre is not the real thing. At his swearing-in, surrounded by friends, he lacked gravitas. He pulled the chair, knowing that he did not deserve to be there and that he does not represent the opposition in the country. In David Pierre, Parti Lepep and its corrupt judiciary have engineered a coup d'etat against the opposition in the country.

Now that he has fallen out with his comrades on the Parti Lepep's Central Committee, speaker Herminie has decreed that the assembly speaker will no longer sit on committees of political parties. For years he has ignored calls to respect the political independence of the office of speaker. As usual, Parti Lepep rewrites the rules and the constitution to suit them.

Marie-Louise Potter praised Pierre for using peaceful and legal means to claim his seat. What would Albert Rene say ? Parti Lepep was once SPUP. Albert Rene violently overthrew the democratically elected government, after having lost all free and fair elections under British rule. It is this act of high treason that has allowed Potter to prosper and become leader of Government Business. Potter's amnesia only made last Thursday's spectacle in the national assembly stranger.

After that earth-shattering Court of Appeal judgment, it is -- amazingly -- business as usual in Seychelles.

Will no one have the decency to resign over the PDM/Court of Appeal scandal ?

Right now, no lawyer, magistrate, judge, puisne judge or chief justice can say they know how to interpret the constitution, even where the constitution is crystal clear, after the Court of Appeal's demagoguery.

Anyone who feels aggrieved with an interpretation or application of a constitutional provision is entitled to take their case all the way to the court of appeal. They have a good chance of winning, except that the justices are inclined to rule in favour of the government.

Electoral Commission

The Court of Appeal has made the Electoral Commission look like fools -- all of them, especially Gappy. Gappy's credibility with his fellow commissioners has been damaged. He can no longer claim to know the electoral laws of this country, without a Court of Appeal's ruling. The whole commission should have resigned -- over a point of principle and honour -- over the Court of Appeal's blatant rewriting of the constitution to suit the government and its proxies. At the very least Gappy should resign, rather than soldier on as a wounded dog for the sake of his salary.

Constitutional Court/Supreme Court

The CC judges came from the Supreme Court. Our judges are not usually recognised for their independence from the executive. It came as a surprise when 2 of them, including the Chief Justice, upheld the supremacy of the constitution and went against the wishes of the ruling party. They have been overruled by less qualified justices in the Court of Appeal. They have been belittled and their credibility damaged. With the open interference of Parti Lepep's Central Committee, the Chief Justice would be entitled to feel that there has been political interference in the Court of Appeal, especially with the vulnerabilities of Mathilda Twomey. Why has he not resigned in protest and saved the honour of the Supreme Court ? It has been a long time since a Chief Justice of the Supreme Court has stood up to the executive.

Court of Appeal

Quite frankly all 3 of them should resign in disgrace. But they are unlikely to do that. They have been appointed by Parti Lepep and placed there to protect the interests of that party. In that respect, they have not been disappointing. But they have driven a coach and horses through the constitution. Where there was clarity, they have intentionally inserted vagueness, blurriness and murkiness.

Now that Mathilda Twomey has capriciously taken on the free press for daring to expose the circumstances of her appointment while claiming it was an attempt to influence her, she should resign if he loses the case. Her far from exemplary behaviour so far tells us this is unlikely.

It would be nice if Gaswaga were to throw out her complaints as petulant and groundless and label her a bullying old harridan who has taken exception to her vulnerabilities and suitability as an independent justice of the Court of Appeal being exposed in the free press. Will that force her to do the decent thing ? Time will tell but I doubt it.

When the Volcere case resumes in January, will the Chief Justice send the police and security forces packing and make sure that justice is done in public and not behind closed doors ? The security thugs are unpredictable. They are more likely to cause disorder for which the Chief Justice will carry moral responsibility, as if his problems are not enough. There has been enough damage inflicted on his institution by Parti Lepep.

Can you enlighten us as to why such decrepancies in the number of seats and forever hold your piss....errrhhh peace.

In the same mould, can you please tell us why Turkey invaded Cyprus?.

In TODAY, it quoted the Electoral Commission of "not agreeing with the decision but will however abide by the decision."

That's democracy in the expressing a point of view with due respect to the Court.

In Volcere's case, the man must plead naivety and publicly apologise and be Man enough to ask for forgiveness for not only being disrespectful to Judge Mathilda, but for being contempt of Court which normally carries a heavy fine, jail or both in Australia.

Will Volcere be Man enough to admit his erronous ways to the Judge involved for his own good.

I guess time will tell.

I am dismayed at the cynical, sarcastic, disparaging and overall disrespectful statements contained in affidavits and statements in court by Counsel during the proceedings. In the practice of law it is the tradition of the noble profession of the Bar to uphold the rule of law. It is a poor reflection of one's professional and ethical standards to slip into attitudes, tones, language and vocabulary that do not befit the Bar. It does good to neither the legal practitioner, nor the profession, nor the client, nor the rule of law.

3) At the same time, for the proper discharge of their responsibilities, Courts require
a minimum of respect. In this regard I direct Counsel's attention to rule 17 (6) (b) (ii) of the Seychelles Court of Appeal Rules 2005, which although is applicable to cases of criminal matters should apply to all appeals in general, namely:

17(6)"Every application, answer and reply-

i. (b) shall not...

ii. (ii) traverse extraneous matters.

4) The professionalism of the Bar is seriously called into question in such cases and
such behaviour threatens the administration of justice and damages the whole judicial process of which we all form part and strive to improve. Members of the Bar are above all officers of the court. A basic tenet of most Bar Associations - and here I quote the American Bar Association Canon of Ethics in the absence of a parallel code of conduct for the Bar Association of Seychelles - is that

"...it is the duty of the lawyer to maintain towards the Courts a respectful attitude. This is not for the sake of the temporary incumbent of the judicial office, but for the maintenance of its supreme importance. Judges, not being wholly free to defend themselves, are peculiarly entitled to receive the support of the Bar against unjust criticism and clamour. Whenever there is proper ground for serious complaint of a judicial officer, it is the right and duty of the lawyer to submit his grievances to the proper authorities. In such cases, but not otherwise, such charges should be encouraged and the person making them should be protected."

5) This Court is concerned with the constitutional and legal issues arising from the matter before it. It is neither interested in Counsel's opinion of the Court nor in the politics of the day. These will remain outside the door of this Court and all concerned are advised to take note.

6) I strongly urge all member of the Seychelles Bar to desist from such actions in the future and to focus their efforts on the legal issues to be decided instead. This may well improve the lack of erudition of late unfortunately common in this jurisdiction.

TIKLO Proxy for rene the Butcher:

Proxy, you sure do have a thin skin. Don't you, Proxy?

Beneath that thin skin of yours, you seem to be a tad confused about what constitutes freedom of speech. My calling you what you are - Proxy for rene the Butcher - does not prevent you from expressing any of your views. Therefore, it cannot constitute an impediment or restriction on your right to speak freely.

If I said you could not write or speak freely because of my opinion that you are a proxy for rene the Butcher, then, you would be justified in your whining. But at this point I have never said that and never will. This kind of oppression and violation of our rights to exercise our freedom to speak and assemble freely, I leave to your friends in the Pp Collaborator government as they recently showed at the courthouse in Victoria.

If I have chilled you in your expressing demagoguery, if I have chilled you in presenting faulty analogies, or your responding to reasoned arguments by lobbing personal insults, or exposed you for who you truly are, then, isn't that the whole point of a free debate Proxy?

But, what is a blatant attack on our democratic right to speak and assemble freely is the spectacle of an appeals court judge abusing the power of her office to silence critics of the manner in which she was appointed. Commentaries about the manner in which judges are appointed, especially if it is suspected to be in corrupt circumstances, should never be silenced or chilled. These kinds of restrictions on our liberty must stop. We Seselwa Rasin will take for ourselves the greatest latitude in expressing our opinions and grievances over any and all matters relating to or affecting our motherland no matter what you Collaborators say or do.

So no Proxy, there is no threat to your freedom to speak from me. To the contrary, they are safe with me. I will defend your right to speak freely to my last breath, even though I know each of your breaths used to spout your insults are more ill intentioned and toxic than the radioactive water leaking from Fukushima. But I will show your toxic nature and character by reason and argument, and not be restrictions, violence and oppression as you Collaborators do.

Insofar as ripping my "bloody arm off". Well. What could anyone expect from a Collaborator like you Proxy. When your argument fails; when your reasoning fails, why, just tear the arm off your opponent. That should settle it. Right, Proxy? Old habits sure do die hard, hey, Proxy?

What's the matter Proxy - need a little torture and the taste of blood to lift your spirits in this Christmas season, and to remind you of old times? Is that what's going on here, Proxy?

And, thank you for your Christmas greeting. Allow me to do the same. Merry Christmas to you and your fellow Collaborators, Proxy - from us in Praslin.

Reply to Anonymous on Pierre -

The David Pierre situation is not about only Pierre betraying the opposition, it is more about PL Communists buying the opposition.

The Pierre buy out, which is ill advised, and can only bring greater disrepute to the Communists is hurting Seychelles image badly.

Unfortunately, the Communists have been buying out the Opposition for years to stay in power.

The sell outs are all guilty just like Pierre. They should all spend time in a moment of reflection, including their lawyers, who are the money bag carriers.

Who finances the SNP? Opposition supporters only? No, PL Communists and their agents finance SNP, perhaps more then opposition donors.

Who finances DP?

Same Answer.

Who finances PDM?

Same answer.

Who finances SFP- definately not PL Communists or their agents. We make sure Communists agents do not touch SFP. Only SFP can safe guard the principle of "Sesel Pou Seselwa" today.

Sorry but the picture is wider lens then you make it out to be.

Once the opposition sees the mess it is in, perhaps they will be wise enough to round table themselves to face down the Communists.

In the meantime, they remain a divisible unit, intentionally, and the results of that will be more of the same to please the PL Communists, who finance them.

Reply to Twisted Cross the Floor-

You say that I affected DP and its leadership fell flat on the floor when I crossed the floor in 1998 attempting to draw a similar line between the Pierre scam and SNP leadership today.

The DP leadership terminated my party membership in 1994 by press release in the Nation and "En Avant", claiming that I falsely claimed I was the son of Mickey Mancham.

Between 1994-1998 DP did not speak to me not even a hello, and this was under orders of our false prophet of peace, Sir James Mancham.

At the DP Convention in 1994, armed PMU SSU unit requested by Sir James, a Gusi Peace Award winner, sequestered me and prevented me from challenging his defunct leadership at the time.

In that time I used every opportunity to attack SPPF. I did it so well, that my leader Uncle, Sir James Mancham went into conspiracy with Rene and SPPF which is obvious to us all today, but was not so obvious back then to the Public...to threaten me, intimidate me, attempt to kill me at the time.

The traitor act was Mancham conspiring with Rene to silent my speech.Anyone with half a brain can see this today.

Faced with a sell out like Mancham, a bunch of sell outs in SNP as exposed to the public today, at the time, the choice to survive provided few options, literally.

I have never taken a cent from SPPF. So I refute these false statements and attempt to pass by case off as being like the case of David Pierre.

I have never been a paid informant for State House. Can Ramkalawan say that?

I have never been paid by SPPF to stand in an election as we see SNP and DP having done so, like Sponge Bob party today. Can Pierre , Volcere, Ramkalawan say that? No.

I have never sold land to Khalifa or . Can Georges say that? No.

I have never sold Felicite Island for one rupee, nor have I helped any Arab group buy out our patrimony. Can Georges say that? No.

I returned to politics simply for one reason: I knew the opposition was part of the conspiracy to sell us out with the SPPF, and if I remained silent, I knew we will loose our country to Fabrikes and foreign interests.

To move forward, Seychelles must rise about petty issues and do what is right for her people. No one else will do it, not even some of our own people. They are Collaborators to sell our patrimony, and we need to wake up to their aggressive nature, and divisive tactics.

The sell outs are weak men faced with great temptation , financed by Khalifa, Siva, Ramadoss and so on.

We must all find the strength to protect our patrimony and defend Sesel Pou Seselwa!

This calls on all Seychellois, Pierre, Ramkalawan, Volcere, Boulle, Gill, Herminie, to stand up for your motherland and do the right thing.

It is easy to sell out, but it is hard to stand up for what is right.

But I ask you all, what will your children remember you for?

Selling out? Or doing the right thing for them and Seychelles?

Even David Pierre saw the funny side of his appointment as leader of Parti Lepep's opposition in the national assembly. He laughed nervously and said "mon nomin monmenm Monsieur David Pierre". The occasion lacked solemnity, constitutionality and legitimacy.

He did not get 10% of total votes cast as required by the constitution. As a self-styled leader of the opposition, he is a constitutional monstrosity. He was placed in the national assembly by errant judges who are too indebted to the ruling party.

The collapse of Air Seychelles is the direct result of Parti Lepep’s incompetence over the last 35 years, in particular the mismanagement of the economy. As the economy is now being run by the IMF, with Danny Faure as the tea boy, Parti Lepep could not even allow HM to borrow money to survive. This is because the “shareholder” that HM likes to refer to is none other than the Seychelles Government now under the care of the IMF.

Now we wait to see the long term effects on the tourism industry. We know that in the short term tourism will suffer, especially over the next 12 months.

Tourists will start booking Easter and summer 2012 holidays soon after Christmas. The lack of a direct flight to Seychelles will influence their decision. The stop-over in UAE and Qatar is far from ideal, as it involves changing planes in the middle of the night. Families will find this especially hard. Planes are parked away from the terminal and there is a bus ride to the terminal. The wait for the flight to Seychelles can be anything from 2 hours to 12 hours in an airport terminal, adding to the cost of the holiday.

That is, if the tourists can get on the plane in the first place. Emirates, Etihad and Qatar are not putting on extra flights from Europe to UAE/Doha. During peak seasons, e.g. Christmas, these airlines will be full of middle east travelers going home for the holiday. They would have booked well in advance. The planes will be full from Europe to UAE or Doha.

So brace ourselves for the effects of the mismanagement of Air Seychelles on the tourism industry and the economy.

STB talks about flogging two-centre holidays, Middle East—Seychelles, Africa—Seychelles. But is that what tourists want ? Don’t our tourists want 2 weeks in Seychelles and then fly straight back home ? Keep flogging what people do not want.

Michel government is only posturing and they always do the very same things that they say that they going to fight. LEPEP hypocrites give us a break. You are a bunch of deceitful , opportunistic individuals who have sign a pact with the devils. If you could not what is right to your own Seychelloise people. I wonder how to could help the international communities in building a better and prosperous global village.

where is Darling boy David Savy tonight? He should have been on SBC in this debate on Air Seychelles.... Where is he? Why should others be answering question on the plight of HM when we all know that he is the main culprit for our airline going belly up!!! SBC is a bloody joke. They cant even ID the right person for an interview.

Did she actually used the word "bon dye"????

Why hasn't James Michel publicised the condolence message he's sent on the death of Kim Jong Il? Embarassed? South korea did supply SPPF with cement to build maison du peuple and the unity stadium, didn't they???

James michel wants to give the impression that he does not mix with the likes of Kim Jong Il.

Forgive nice-

I do not seek your forgiveness for something I did that you did not understand at the time the complexity of the play.

I have betrayed no one, but only dealt with my enemy and sell out family, as they ought to have been dealt with.

Today Mancham and DP we all see is a national shame of historical proportions.

SNP and Ramkalawan have out done Mancham and DP as a national shame.

PDM spongebob party has stolen the show of shame.

Sorry for calling you a crony.
My fellow countryman Society as institution base of rules of law cannot FORGIVE a criminal for his crimes.Society can either punish someone for his crimes or grant someone amnesty. In both cases JUSTICE must first preveal .FORGIVENESS can only be given by VICTIMS ,thus it can probably only be achieved by having the culprits asking for forgiveness and having the victims accepting their asking for forgivess(for this we will have to have a kind of (truth and reconcialtion Commission).

Time for regime change.

Mathilda Twomey will soon learn that she has bitten more than she can chew!! Her many years of absence from Seychelles life and politics has meant that she has lost touch with the evolution of the struggle for democracy which she so proudly espoused once upon a time.

Many of her friends I spoke to when news of her appointment was made public, questioned her ability to competently discharge the position as a Justice of Appeal, simply because she did not have the experience and baggage required to do so. However many of us were willing to give her our support and blessings, because at the end of the day, few of the other Justices of Appeal, the likes of Macgregor and Hodoul came with much experience and baggage either.

If Ralph published what he did, then Mathilda should realise that this perception is one shared by many Seychellois. She has compounded her “dishonour” by the steps she has taken against him, the first one being the landmark judgement to install David Pierre as Leader of the Opposition.

If Mathilda felt aggrieved by the remarks, she had the option to lodge a civil suit against Ralph. Instead she became vindictive and opted to abuse her position to try and go for the jugular to teach Ralph a lesson. In doing so, she has let her emotions and reason be ruled by vindictiveness, arrogance and vengefulness (because she has had it against Ralph for a long time for writing against the “Irish”). It would have been advisable if she had kept quiet and maintained her dignity, for had she been living in Seychelles she would have discovered that many other judges have been subject to scrutinization and criticisms, and they, wisely, chose not to react.

Her extremely bad judgement to appear in Court accompanied by security personnel only serves to intimidate the public adding to the disdain and contempt in which she is held at the moment. As such the only choice left for her now is to resign.

As for Ralph we will be there to lend him support on his next court appearances. I understand that Boulle will “don” his wig once more to join the defence team of lawyers!

When we live in TRUTH, we expose Communism.

When we expose Communism, we destroy its foundations which are buried in lies and falsehoods.

When destroy the foundations, the fall of the regime is only a question of time.

Rene knows this.

Michel does not believe it.

But he is feeling it everyday, as the international community logs on to star and reality, to see the rot that has been buried in Seychelles all these years.

No living can forgive another for the death of a fellow citizen. Only justice can do this when delivered.

The Statute of Limitations on murder?

There is none.

Of course, we must not forget Twomey's Irish connection. Hubby is Irish and sprogs are half Irish. Seychelles Weekly has been campaigning against Michel's Irish imports and their arrogance. It is a blatant abuse of position and she should resign.

As Ramkalawan says, no one can expect justice before that woman anymore.

Sheikh Khalifa must be a bit apprehensive about the toast to the UAE by Jean Paul Adam, as we still remember the least time he made a toast to "Brother Gadaffi".

What caught my attention was the Big Photos of Khalifa and that of Michel. As if Michel is the King of Seychelles.

Mathilda Twomey did not stop to think about the implications of her actions, both the judgement in favour of PDM and bringing contempt of court charges against editor of Seychelles Weekly. Both actions were clearly wrong and disgraceful. The Court of Appeal is being badly damaged. The contempt of court charges look trumped-up and the impression is that both Twomey and Govinden are relying on compliant and fearful judges both in the Supreme Court and later Court of Appeal to jail the editor of Seychelles Weekly, to appease the naked and dangerous capriciousness of a judge who has lost direction, dignity and commonsense and to please Parti Lepep who is always using the judiciary to destroy the opposition. If Volcere is jailed, all the parties involved (Govinden, Twomey, Gaswaga and justices in the Court of Appeal) can expect their stock with Parti Lepep government to rise because we know that Parti Lepep likes it when the opposition gets a blow from the judiciary. Call this juctice ?

Yes, fucking little Adam with the big ego, go ahead and celebrate UAE and Sheikh Khalifa just like you did with Gaddafi last year. Maybe you can bend over your gay ass at the new mosque next year as well so that the Arabs fuck you and Michel some more. Then you can give them the moutnains of Zimbabwe Praslin for the new Crown prince and then our airport and then Dubai World can take over our Victoria port just as Michel has planned. With the new Victoria being planned out in Abu Dhabi I am sure you and Morgan have carved a piece for yourselves you fucking little hungry mongrels. But do not worry as soon you willfind out who the real boss is.

C. Gill crossed the floor to seek political asylum with SPPF “because Mancham and DP with the collaboration of Rene” wanted him assassinated! Yet he crossed to Rene’s party...like walikng into the lion's den! Sometimes when one tells a lie often enough it becomes reality in his mind!
He defected for “political reasons” so to speak and exiled himself with the party whose leader according to him wanted to kill him and that he is now keen to destroy!
