Seychelles Goes Back To One Party State

The National Assembly elections last weekend has confirmed that Seychelles, under James Alix Michel, is now in a one party state officially. The PL won all seats in the National Assembly with a 50% poll and PDM fielded a desperate 7.4% and failed to get even one seat on a proportional basis because the high number of spoilt ballots exceeded 16,500. The high number of no shows as well, in response to the UNITED BOYCOTT campaign pressed David Pierre’s allegedly rouge opposition party back into the Pandora’s Box where it came from. Pierre even forgot to remove his sunglasses on his cap and head, though it was after midnight.

There were more voters that did not vote for PL which includes spoilt votes, non voters, then those that did vote for PL . Hence, they do not rule with a majority, but they do hold every single seat in National Assembly. This is very communist. It calls for the drafting of a new constitution to reflect the reality that every voice counts. The 3rd Republic has become exposed as being dysfunctional after years and years of cover up by SPPF and SNP leadership.

The PL leadership openly displayed their facial grief on SBC as the results were made Public, when it was announced that their apparent grandiose plan to field a fake opposition, millions of rupees later, apparently, had failed miserably. This is a political BACKFIRE of the highest quality!

Michel even said, he would have liked to have an opposition to debate with since Pierre indicated he would be debating in a responsible manner to Michel’s satisfaction.

You do not get comments that can be more communist then this. It shows how Seychelles has been living in the one party state in Michel’s mind, all along.

No Opposition Then One Party State

The lack of an opposition now means the PL have caused Seychelles to be  labeled a one party autocrat state officially. This is the same title that graced Seychelles from 1977-1991 under Rene’s one party state. This dubious title, now makes Seychelles under James Michel, a regional pariah, for failing, in due course, over the last Eighteen (18) years, to implement the democratic reforms, electoral reforms, and freedom promised by F. A. Rene, but never delivered by James Michel. Ironically, only James Michel autocrat “grace” can now move the country forward if we are to avoid as one PL said: “civil war”.

Most recently, James Michel was appearing on SBC to be very arrogant and authoritative. We saw him more often then we saw the news presenters themselves. One party state tactics were started to be used again, under his presidency. Example, State House thugs regularly call and harass Freedom Party staff over the good work we are doing to bring unity of purpose in the opposition, and change in Seychelles.

The incidences are so numerous, it is not worth mentioning in an article, I would need a Excel spreadsheet to list them all. We will start listing them, and seek damages for them, and seek Michel’s public commitment that it shall also stop, before we move on.

With no opposition, key provisions of the Constitution of Seychelles cannot be operative. The PL will now have no one to debate with as I promised would happen. They will now debate with themselves. As such, it will be conclusive that the one party state culture is alive and well in Seychelles, until we destroy it permanently or it destroys the Communists. The choice is now yours Mr. Michel and communist company.

A New Level of National Shame

Shame has taken a new level for James Michel, who at one point tried to pass F.A. Rene off as a dictator with the diplomatic corps and in private and passed himself off as a reformer , democrat and admirer of the free world. He distant himself with Rene, by whining down meetings with Rene, and saying: “Michel has his own style” in the early days of his assuming the Presidency. I cannot argue with that. His style has now taken Seychelles back to one party state.

In 2004 Michel even referred to himself as: ”President of all Seychellois”. Just the new tenants at Ile Preserverans shows he is the President of just the Communists. Where are the 50% opposition tenants at Ile Preservans, Michel?

Right now, Michel is looking worse then Rene for Seychelles. In the coming months we will see if he can rehabilitate himself under the pressure his own deeds will bring to his door step. As President, he holds considerable domestic power, and can do the right thing if he chooses to.

International Pressure Will Bear Down on Michel

While the PL candidates were using the district offices for a celebration orgy of booze and food, another one party state syndrome at play, they had no clue, that the election results will bring a wrath of critic and pressure upon the PL. Western European states will no longer tell us to give examples of one party state in play. We will tell them to go count red shirts in the National Assembly, and count them at State House. That will be enough.

While they danced and boozed freely on government property as if they owned it, they were in fact bringing greater shame upon their communist party and exposing its one party state fixation that is destroying Seychelles bit by bit, day by day, life by life, because………., we are not FREE.

International Pressure Will Be Painful

No western country will be able to give out assistance to a rouge one party state. We have become a regional pariah overnight under James Michel. As aid is cut, diplomats will start to voice their opinions because their politicians back home will not be able to sustain the syndrome of guilt by association with the PL as they face legitimate elections and their press and people.

We will get less help on our national bankruptcy brought on by Michel himself. Michel knows this. This is why he recklessly pushed the wild card of ZEEDA Party into play.

A country cannot field fake opposition parties. It is treacherous and destructive to the social cohesion of society. Michel has seen this in the “Spoilt Votes” and “No Votes”. It was as if the light bulb clicked finally.

The numbers are enough to drive the sense of respect into his heart . This silent majority, has PL scared for its future. The international community cannot ignore that the PL rule by hook of a perverted system that is no

longer functional for Seychelles today. They will press for Democracy in Seychelles, and when they do, we at home must press for Freedom.

This task is not for the novice to orchestrate. Hence, we ask SNP leadership to simply follow our steps so they do not get twisted themselves. We will keep them informed and they can copy and paste if they like. But please, give credit where credit is due. When you take and give no credit, you are acting like communists. It just is not acceptable conduct in the free world. It is shameful and destructive to social cohesion in the opposition community!

After telling us we are in a Democracy for 18 years, and after telling us you believe in the BALLOT BOX, it was nice of you to turn up for a BOYCOTT, finally. Now, you see what kind of progress we can make in quick time when we do not think about our salary and pensions of Sr.32,000.00 for life. Bravo!

We will need to get PL to cancel these pensions for politicians, don’t you think? Let me know how you feel about this.

Massive Economic Depression Ahead

While we face this political calamity created by PL, looming over our heads is a massive economic depression ahead for Seychelles, that will outlast F.A. Rene ‘s life, James Michel life, and perhaps Danny Faure’s life, if they do not take bold steps now in the direction of fostering genuine social cohesion in Seychelles.

Real Social Cohesion

Social cohesion cannot be made by artificial means and gestures that are not sincere. They must be real. The first order of the day in the CC where the Communists deliberate is: 1. STOP THE VICTIMIZATION. 2. You Need a Round Table of all parties to discuss the way forward. 3. You must retire the thugs and killers in your operation that threaten our people everyday, take their guns and knives, charge them with some crimes. Send them to jail for the sake of national PEACE. 4. Finally, disclose all arrangements with ZEEDA Party so it can be wind up, as it is an appendage going no where. It is a bit of a Frankenstein party, created out of the belly of SNP, but fed by the communists. A very strange thing, but Pierre seems like he can live under his skin so far, as long as he has a cap.

Then we will take it to the next step.

We will not live in FEAR…… of a failure organization!

One Party State You Want, One Party State You Got!

Time To Move On!

By Bernard Georges (Part I)- "THERE IS NO WILL THERE. UNTIL THERE IS, THIS COUNTRY WILL REMAIN DIVIDED” Much has been said during the course of this campaign for the National Assembly elections of the reasons for the opposition boycott of the elections and whether this was a wise decision or not. As one of those who supported – and still support – the decision for the boycott, I feel it is my duty to remind your readers... of the reasons and the justification for the boycott. First and foremost, it is worth reminding people that a political party does not decide to refrain from doing what comes naturally to it, namely contesting elections and participating in the political life of the country, unless there are very good reasons. Second, it is important to realise that leaders in the opposition are not idiots, but mature politicians with huge experience of the political realities of our country. For the most part, these leaders have been active in the political fray for decades and have paid heavily for their action – by denial, imprisonment, and blood. The leaders of the boycott are not children angry at being denied a toy, but mature men and women capable of making reasoned and balanced judgments. In my view, it is only in that context that sceptics can appreciate and understand why these elections are going ahead without the main-stream opposition participating. The 2011 Presidential elections were flawed. They gave victory to one candidate who had been able to marshal advantages denied to his opponents. Everyone realised that unless there was serious electoral reform before the next elections, the outcome of these would – for the same reasons – be equally flawed. The opposition was thus faced with a stark choice – continue as before and participate in a contest which was not fair, or press for urgent and comprehensive reforms before the elections. Naturally, the opposition, being responsible and loyal to the country’s aspirations and to its own principles, chose the latter option. The opposition did not do so in the dark. It made known its requests publicly and repeatedly – in lists of reforms necessary, in press releases, in my comprehensive document called Democracy Delayed and in a motion brought to the National Assembly proposing the establishment of an electoral reform commission comprising all stakeholders.

PART II - By Bernard Georges

To urge focus on the need for reform, the opposition in the National Assembly used the only tool at its disposal. It made known publicly that it would participate in Assembly work only insofar as that focussed on electoral reform. The government responded to these requests in the following manner: it voted down the motion, it criticised the opposition action and it replaced the electoral commissioner by a 5-member commission. This, in its view, would be the catalyst for the electoral reform. But it did something else which clearly demonstrates that it was not genuine in its talk of reform. It dissolved the Assembly. Faced with the boycott of the polls by the mainstream opposition, the campaign of the government has centred on asking the nation to vote for a National Assembly because it is only with a National Assembly that reform can be implemented. This begs a major question: why, then, was the National Assembly dissolved? The country had an Assembly with some 9 months still to serve. The opposition had made known its commitment to participate in electoral reform. If the government were serious about reform of the electoral process, there was it's chance. It chose, instead, to kill that chance. Why? The answer is simple to anyone but the most obtuse. Either the government is not minded to implement electoral reform at all – other than what it has done – or it didn’t want to do it before the National Assembly elections so that it would go into them with all its advantages. Either way, the opposition had no option, but to refuse to participate in the process. That is the plain and simple truth in this matter. If the government says otherwise, it is not being honest with the people. Why do I say that? Well, for three reasons: The government never implemented any suggested reforms made by the foreign electoral observers until after it had won the Presidential Elections. The government dissolved the National Assembly to avoid having to make reforms before the National Assembly elections. The President is still using State House to make political appearances, as we saw on Sunday evening. There is no will there. Until there is, this country will remain divided. That’s the simple and stark reality. By: Bernard Georges

That is a nice story posted by SNP office.

Congratulations.

I have some questions to clear up the ambiguity in the statements I perceive. Please help me and others.

1. What were you doing in the National Assembly all these years, if democracy and reforms were not being delivered?

2. If it was so bad, why did SNP take the pensions they voted along with SPPF PL on the way out?

3. Is it not true, that you mature leaders walked out with pensions for life of Sr. 10,000.00 per month to Sr. 32,000.00 per month, all of you?

4. Is it not true the people walked out with nothing delivered by you as promised after 18 years?

5. For that, is Mr. Georges posting this, to hint that SNP needs 18 more years to deliver?

Is it not true, that SNP is in a twisted conspiracy with SPPF PL to fake democracy for a number of years and fool our people?

How many times has Ramkalawan Georges and company told us we are in a democracy?

How many times has Ramkalawan

Georges and company told us they believe in the Ballot Box?

The answer to these questions, exposes the falsehood of this post part I and part II.

It sounds more like a closing argument to defend a political criminal or gang.

The biggest falsehood is the assertion that the country is divided because of no reforms.

The country has been divided since 1964, before SNP even existed. Before that it was divided on other socio political circumstance before the era of Mancham and Rene.

A little intellectual honesty will go a long way in these lean times, especially on closing arguments.

When we face communists, that take away our freedom, and enslave us, we do not need excuses for failing.

Being victimized, I would have thought, SNP leadership, by now, would have realized, is NORMAL in this game vs. Communism.

We need a plan for results, not a plan for excuses!

Beyond Pathetic.

So PDM goes to the constitutional court to challenge the outcome of the elections. Is Pierre hoping that the Attorney General will not enthusiastically defend Gappy this time ?

Interestingly, Parti Lepep is not going to court on the issue. Yet, if Pierre wins, PDM will get a seat and PL will get two more seats.

Are PDM and PL collaborating on this ? PL will pull the strings for the judges behind the scenes, while PDM fronts the case and the attempt to intimidate the judges. It is hard to see that they have not discussed their strategy.

In fact, the whole premise of Pierre's case is wrong, as reported in Nation. Gappy said the allocation of proportional seats was done on votes cast since 1996. A calculation of the proportional seats since 1996 shows that it was done on votes cast. How can Pierre prove that it was not done on total votes cast ? Pierre must be desperate and trying his luck, or in a sinister way relying on Parti Lepep's bent judges and a corrupt judiciary to get into the national assembly.

Anonymous said...

Having failed to get into the assembly on people's votes and having been massively rejected by the opposition.

Govinden may well want PL and PDM to win. This is a case where he should not represent the Electoral Commission.

But if Gappy loses and the judges say that Gappy did his calculations in the past on valid votes, there will two points to consider.

The judges wil be saying that Gappy lied on SBC and in court. His position will be untenable. The whole electoral commission will be disgraced, along with the man that appointed them.

Even if Gappy got his calculations wrong in the past, it does not mean the mistake should be repeated to please Pierre. It is irrelevant if the calculation was wrong in the past, as long as it is correct for 2011.

The important issue is what does the 1996 constitutional amendment mean by "votes cast". Did it mean just valid votes to be counted for the candidates, or all votes placed in ballot boxes including those deliberately spoilt ?

Any reasonable person would say that "votes cast" means all votes cast in the ballot boxes using valid ballot papers. But we know that Pierre is now an irrational man, seeking an irrational decision from Parti Lepep's judges, knowing that the judges know that Parti Lepep want him to win and that Parti Lepep is the big beneficiary and real petitioner in this case.

No news yet of the 6 goons that PL will put into the national assembly through the back door ? The usual incompetent suspects - Rose, Potter, Herminie - will be joined by who this time ? Friday is the deadline. Wouldn't it be nice if out of embarrassment at the electoral farce they refuse to nominate anyone to this illegitimate assembly ?

What's for part 3, Gill ? Cut and paste part 1 ?

We really need a psychologist to examine the State of mind of Mr Christopher Gill. It seems that he has the god given right to excuse himself for crossing the floor and other cannot to so.
Everyday he talks about united the opposition and at the same time everyday he is bashing SNP supporters and it leadership by calling them pathetic and all sorts of names.
It seems that he has a very short memory that he was also part of this fake democracy he was talking about and he joined SPPF party during his floor crossing to raise his hands on every motion that were proposed during his tenure. Gill A KETTLE CANNOT CALL A TEAPOT BLACK.
It seems that after you failed miserable to hijack the democratic party now you are targeting the SNP party. This will not happen and you will surely get the same predicament has David Pierre. Remember with all your cheap talk you have never tested yourself in any election in the Seychelles. Once you crossed the floor you went into hibernation for a long period of time.
The only conclusion that could be drawn from this irrational behaviors is that Gill is behaving as a parasite, he is trying to get a host to carry him and his political dreams along. So he wants to get into the opposition forum to create division so that he would be able to kidnap the opposition parties.
Be a real leader my friend try to build your own party that you have created whether you like it or not SNP is the biggest opposition party to date in the Seychelles. Your tactics will backfire on you one day. Remember Seychelloise people is looking for genuine leader not politicall ambitious parasite who wants to be in the limelight just by slandering people in opposition to get political mileage. Thanks that SNP never mention your name positively or negatively on their papers. As a supporter of the opposition I think that the SNP leadership will be making another costly mistake by sitting with you in any opposition forum because your ego is too big.
Sorry to tell you that your so call intellectual strategies of slandering will fail big time.

Having joined Parti Lepep, Pierre thought he only had to click his fingers for the Electoral Commission to cave in. Now he is going to court to tell the judges that Gappy has been horrible to him and denied him his place in the national assembly, his title, his salary and pension and denied the pretence of debating against Parti Lepep and the pleasure of cavorting with Marie Louise Potter or Marie-Antoinette Rose, whoever gets in through the back door like him.

He can't get over the fact that UO and Ramkalawan got into the national assembly on less than 10% of votes cast in 1993. He wants the same thing to happen to him, even if the constitution was changed in 1996 by SPPF, at a time when they did not expect traitors like Pierre will betray the opposition and will get less than 10% in future elections.

Having pointed out to us that Parti Lepep will gain two extra seats if Pierre wins, Seychelles Nation should have told us why Parti Lepep is not petitioning the constitutional court. It is not like Parti Lepep to let go what they think belongs to them, being prepared to steal other people's property. Do they want to get the extra seats without being seen to be asking, while Pierre goes out on a limb begging the judges to subvert our constitution in an area where the language and meaning of the constitutional provision are crystal clear ? Pierre is a disgrace.

Anonymous said...

Good question. Why is parti Lepep not petitioning the constitutional court ? Do they think Gappy is right ?

Anonymous said...

Why they're nto petitioning? Simple: Because even if Pierre gets his seat + Ramkalawan's salary they'll still be in majority by a landslide so it wouldn't make any difference whatsoever.

Reality check-

Even Pierre's votes are not his. PL made their own people vote for Pierre to try to get him to 10%.

As I predicted it would happen, they could not manage it well, because you can simply only stage manage an election only so much, before everyone gets drunk and in coherent.

Pierre's real support base was, and I say was, in the area of 1-2% if even that.

Remember, he told us he campaigned and door to doored Mont Buxton for over one year and he polled a bit over 300 votes. That works out to about gaining 100 votes per year. This is a bit less then the number of comments per article here.

When all is said and done, the votes, all of them, belong to the person casting, not to political parties or personalities. This is where we trip up.

What needs to be done, is that we try to think holistic and come up with solid plan and ideas to push the agenda for 1. Democracy, 2. Freedom and 3. Regime Change forward.

At Freedom Party have solid ideas on how that can be done.

But unfortunately, that cannot be done when Wavel Ramkalawan is looking for a tete a tete with James Michel. That is the worse case course of action right now.

It will lead to another BOYCOTT down the road.

If the conditions are not right, we will BOYCOTT!

The Boycott is a fundamental game changer that alters the way things will be done from the past.

There will be no window dressings to fake democracy in Seychelles again!

If we use the same old past failed ideas, to bring about change, we will unfortunately, not just go around in circles, but we will all go down the drain as we whirlpool to no where.

Right now, the opposition is whirl pooling to no where under Ramkalawan and his first bad idea since the BOYCOTT results.

Sorry, as humble as I can put it, we will not be a part of this strategy, quite simply, because, we do not want to go down any drains.

When SNP leadership is prepared to put false pride aside, we are ready to talk and dialogue any time, any where, for a better Seychelles and yes, for 1. Democracy, 2. Freedom and 3. regime change.

We speak frankly with Mr. Volcere, Mr. Boulle, and Mr. Dhanjee so we have no problem speaking to SNP.

They can send their driver first if they like, since I know they operate on a Plantation system there.

I remember a teacher in primary school use to tell our class when people would be hurt because of words said in the sand box: "if you can dish it out, you better be prepared to take it if you cannot take it, keep your mouth shut".

Perhaps this is a moment for due reflection for everyone.

Thank you for your time, and do have a great day, make it the best you ever had in your life, live your dreams for the entire 24 hours and be free. If we all do that, Communism will crumble- like a paper air plane to the bins of history.

I think there should be an open televise debate whereby journalists from different newspapers can come question Michel as President of this country.Instead of wasting tax payers money in a programme named En moman Avek Presiden-we could name it En MoNAN avek Lapress.Thereis millions of questions and issues the people would like to answers from Michel .After all he is the president he should be answering any question asked by the people he is their servant they have a right to know.

On Pierre,
The guy who supposed to be proffesor in mathematics has run at of formulae,he has taken two to three days trying to figure uot that mathematic formulae could help him get a seat ,after lots of additions, substracting, divisiona, and multiplication he has ended up with thwe same result namely EQUAL ZERO SEAT.The best option for Pierre is to accept the fact that he was to greedy ,he was focusing of the perks PP offered him that he was binded to see that Pp was just usung and abusing him for their own politcal gain.He should dissolve his ZEEDA party and stop wasting judges time for an case which uot outcome will be altered (there are important cases for judges have to deal with) and go into forced retirement.

As I've said before, Christopher better get down from his little cloud. He has absolutely no influence on anything in this country and will never have.
Until further notice, SNP remains the largest opposition party in this country and it's up to its leadership to decide how to proceed as an opposition party. So far, they have decided to work together with NDP and Mr. Boulle. It's brought positive results in the recent assembly elections. Long may be this cooperation continue.

Why David Pierre insists on humiliating himself is beyond me.
It's amazing what money, position, privilege, greed, can do to people.
The court will certainly consider his case as they've done for others before but seriously, what does he hope to achieve? Would he be comfortable sitting the assembly on the back of a court decision if it came to that? Doesn't it show desperation on his part? Can somebody please take him out of his misery?

There appears to be an affliction hitting the Manchams and their descendents - la folie de grandeur. Their belief in their self importance.
We see it everyday with James Mancham, the many conferences he announces which nobody here know nothing about and couldn't give a rat's bottom about. The nephew now wants to give the world the impression that the opposition in Seychelles is HIM. That James Michel is trembling in his little shoes at the mere mention of HIS name.

When Gill finally organises a long overdue SFP public meeting, Jean Paul Isaac will be there in person and Jeanne D'Arc will be there in spirit. There's the promised throng. Gill's gone gaga.

At least Pierre can rely on Parti Lepep's rent-a-crowd for his meeting, just like he relied on Parti Lepep's rent-a-voter to jazz up PDM's score in the elections a few days ago.

There is also Gill's mate Viral Dhanjee and his off the wall political theory. Birds of feather and all that jazz. Like Gill, he thinks money maketh politician.

However, I am pleased to see that Dhanjee is using his money to challenge the constitutionality of the re-appointment of foreign judges. It is a much much better use of his money, than trying to get into politics.

SNP's support was shown in May 2011elections, but it is clear that the Alliance of Ramkalawan, Volcere and Boulle has pushed up that support which the opposition got in the National Assembly elections to achieve a result of nearly 49.5%

It is obvious that what the people wanted and has always wanted is for the opposition to unite to fight the system and clearly their support has manifested this.

Now it is up to that opposition to decide if they are going to take up the challenge and show they are worthy of this trust?? SFP could decide to get on board or remain marginalised but what we must realise is that, to coin the words of Michel "the people will judge us by our actions".

I have no doubt that there is enough wisdom, ability, determination and goodwill in those men and women who really have Seychelles's interests at heart to forge the right way forward.

The cracks in our social fabrics you morons have been caused by your president for being unable to keep his old little willy in his lanmores. It is caused by your ministers sleeping around like there's no tommorrow.
Just stop and look around you, you brainless moron.

Answer to post of Christopher Gill dated 6 October.

1. Were you not a member of the National Assembly in 1998 onwards, did you bring changes to democratise the country or you betrayed the people of seychelles who elected you and crossed over to the sppf/parti lepep camp?

2.Were you not receiving a fat salary whilst you were a member of the Assembly, did you refuse to take it in the name of the people?

3.What contribution did you make as a member of the opposition in the Assembly to advance democracy and remove the one-party state mentality?

4. In the end Mr. Gill you supported the sppf, you allowed them to use you, just like David is being used. He will soon wake up from his slumber and realise that he has been used, sold and bought like a commodity.

5. So if I were you I would stop accusing my colleagues in the opposition, when I did the worst to stiffle democracy in Seychelles. Acts by people like you contributed to stall democratic reforms and you have to guts to accuse Bernard Georges and others of doing nothing in the Assembly to advance democracy.

6. You are a hypocrite Mr. Gill and an opportunist trying to ride on the democracy bandwaggon. It will do you or your party good. Come clean and stop accusing others.

I meant it will not do you or your party any goo.

Very well said.
Gill seems to enjoy the bashing he keeps getting and he keeps coming back for more.
I suppose that he's going by the premise that the worst insult anyone can cause you is to ignore you, so he has to come out with these most ridiculous and senseless comments to encourage reaction and try to remain "relevant".

Anonymous said...

That may be so, but Gill will remain irrelevant in the grander scheme of things, as long as he does not grow up.
What I see are not the qualities of a polotical leader, certainly not one that I would want to put my faith in.
We have enough of these jokers around. Let's not add to them.

Pierre goes to court to get crumbs of comfort; logic defied, wants constitution defiled

After the drubbing he got at the hands of an angry electorate last week, Pierre shifts to the constitutional court to find some reward for his treachery. After having failed to get elected by the electorate, he is now seeking election by the judiciary. He is hoping that our reviled judges, with their reputation for pro-government decisions, will defy logic and defile schedule 4(2) of our constitution and hand Pierre the 10% that he spectacularly failed to poll. In court, Pierre is represented by Basil Hoareau who endorsed James Michel in a PPB in the presidential elections.

It is unclear what Pierre is disputing in court, apart from that fact he was not given a proportional seat by the Electoral Commission. He calculated that bagging a seat would be plain sailing, with the real opposition boycotting the polls and fear driving people to the polls. He miscalculated.

Is he arguing that, in the past, proportional seats have been calculated on valid votes and that this method of calculation should be maintained for 2011 elections ? From what has been reported, this appears to be his main argument. Pierre is plainly wrong there. We know that the calculation should have been based on votes cast since 1996. Hendricks Gappy has said publicly that the calculation was based on votes cast. How does Pierre know that the calculation was based on valid votes ? Is he expecting incriminating documents to emerge from the former Electoral Commissioner's office ? In fact, we can all see that the allocation of seats was based on votes cast. No party got an extra seat or was denied a seat because the calculation was erroneously based on valid votes. In fact, as we know now very well, it made no difference to proportional seats even if Gappy might have made an error, because of the low number of spoilt votes in previous elections.

Anonymous said...

Constitution means what it says; says what it means

What is not clear from what is being reported is whether Pierre is also saying that the constitution requires the calculation for proportional seats to be based on valid votes. This would be an argument that the constitution does not mean what it says when it says that Pierre needed 10% of votes cast not valid votes. Pierre is asking judges to rewrite election terminology and this will make the judges a laughing stock. Votes cast mean all valid ballot papers placed in the ballot boxes. Valid votes mean votes to be counted for the election candidates. The turnout of 74% was based on votes cast. In countries where voting is compulsory, there is a big difference between votes cast and valid votes. In Seychelles, voting is practically compulsory and many voters chose not to vote for either PL or PDM. They saw absolutely no difference between the two. Quite rightly too.

Even if Gappy's calculations show that he used valid votes in the past (it made no difference to the allocation of seats), Gappy's mistakes do not set precedents and do not override constitutional provisions. Good judicial decisions set precedents. It would be ironic if the judges were to cede that power to the Chairman of the Electoral Commission, and set precedents for future cases in other areas. If the judges were tempted to indulge in judicial rigmarole to please Parti Lepep government once again, they will be undermining their own role. A shaggy-dog judgement will do just that.

Pierre under the cosh

Pierre told us in April he was a man of logic. We gave him the benefit of the doubt back then. In August, while logical men and women were exhorting the opposition to boycott the polls, Pierre put together a makeshift political outfit to contest them. He is now defying logic by arguing against facts and a clearly written provision of our constitution. He can't have much respect for the judges. The judges should return the compliment in kind in a few days time.

Having sparked off the biggest number of spoilt votes in the history of Seychelles, Pierre is shameless and now wants the constitution soiled so that he can squeeze into the national assembly. If Pierre is finding himself under the cosh, it is because he is a traitor. Traitors watch out !

All indications are that our independent and impartial judges are bent on granting David Pierre & James Michel their very dear wish: Reverse Gappy's decision and give David Pierre that much sought-sfter seat. David Pierre will become the Leader of Opposition and will have the last laugh afterall.James Michel is awaiting thid "great exercise of our democracy" to be photographed with David Pierre. After all these meetings behind closed doors before the election, he will finally be able to present his "lopozisyon responsab" to Seychelles and the world. Who knows - he might even declare a public holiday.

Nothing that happens in this cursed country of ours surprises me. I'm hoping to see Pierre from then on in a red cap at midnight.

Whatever happens David Pierre will never be an opposition leader. First and foremost he did not oppossed his adversary in the national assembly election and I would whom he will oppose in the assembly. I think the the constitutional judges are going to shatter their prestige and integrity even more if they over rule the constitution to give David Pierre the seat in the assembly that he did not deserve because the people had spoken. Anyway in a banana republic all is possible. With Lepep you can be whatever you want to be. As their moto goes.So David Pierre wants to be the leader of opposition James Michel will make him be but the consequences may be very damaging to the image of the Seychelles which is still in limbo in a communist state.

So, no news yet of PL's 6 proportional MNAs ? The constitution gave them 7 days to submit names to the Electoral Commission. The deadline was yesterday. Even if PL argues that the election results were announced on Sunday morning, the names had to be submitted by the end of today.

PL is quite clearly openly sympathising with David Pierre and perhaps openly intimidating the judges. PL would have missed the deadline if Pierre loses his case in a few days' time. Even if Pierre wins, the ruling will apply to the extra two seats for PL.

PL has not challenged the Electoral Commission's decision. But it seems it already knows that the judges will order Gappy to recalculate the proportional seats. If the Constitutional Court does not do it, the Court of Appeal will. Then PL will appoint its 8 members and Pierre will appoint himself.

However if Pierre loses, then PL has forfeited its constitutional right to make appointment for proportional members.

Or is our country so lawless now, that the constitution does not matter and PL will do whatever it wants ? Any challenge to such abuses is bound to fail in the courts because the judges do whatever Parti Lepep want ?

Anonymous said...

No news form Pp and No reaction from Gappy asking Pp why it has not submitted names by now.Pp will do what ever it wants including telling the Constitutional court what to do and dito to Gappy, you have forgotten under which systen we are?We are in a one party state the dear leader has ultimate power and can over rule whatever decissions at will. But all these theatrical shows help us proving Pp one party state which Michel can no longer say the contary. The boycott undressed Pp in the garbs of democracy it was hiding into ,it can no longer hide now.

Lepep is being "magnanim" in "victory". Why do they need to take up the proportional seats when they already have 100% membership? It would be too much of an over-kill. Hasn't the Constitutional Court directed that the new national assembly cannot be convened until after David Pierre's court case? Lepep has no reason to rush to start "work". In fact, they're dreading it.If the Court gives David Pierre the seat he's after and re-calculates Lepe's entitlement, so much the better for all concerned.

The constitution says that the national assembly must be recalled with 4 months of its dissolution, i.e. by 18 November. But as the country is in such a mess, I guess it does not matter if it does not meet by then.

After 2007, we thought PL couldn't amend the constitution. But it did, thanks to Judas Carpin.

I am sure PL will want to use its porportional seats to give its friends a job for the next 5 years and a pension afterwards.

Why not appoint failed PDM candidates. What's wrong with them ? There are 25 of them.

Anonymous said...

That Pp will amend the constitution at will,is not something new,the same way it amended law to retrict the people to exercise their rights of assembly ,the same way it disolved the Assembly, and the same way it has done in the last eighteen years and that with or without oppostion in the Assembly. This time though Pp can use the rubber stamp Assembly to dismantle the Republic or ovethrow the Constitution. However the Constitution belongs to the poeple and thus the decision to amend it should be left to the people. we will make sure that this decision is left to the people else Pp will have to face people protests.

What's wrong with PDM candidates ? Good question. Answers to SBC.

What is Misel lining up for Pierre ? It is hard to see the judges sully their reputation further over spoilt votes with some ballot papers reportedly carrying humorous, graphic, adult protest signs. Apparently on one of them Pierre's missing hair had grown back. Another candidate was given a blow job rather than the tick PL was asking . That's what you get when you have farcical elections.

Anyroad, Misel should open an embassy in Timbuktu. It's in Mali, West Africa, for the geographically-challenged like Misel himself and I dare say the vast majority of PDM candidates.

A shocked Pierre admitted to glum Faure and glummer Michel on election night that it was not easy getting 25 candidates for them. As if we did not know, from the PDM's line up of fools. Making him an ambassador in Timbuktu would give him a suitable refuge to hide his face, once he has failed to drag the judges into his own pickle.

Many violated the electoral laws in spoiling votes
Much is being made in some quarters of the relatively high number of spoilt votes- or rejecting votes in last week’s parliamentary election. Some are claiming that these people wanted to send a “message”. What kind of message. Given that an average `1,500 voters inadvertently spoil their ballot cards at all elections, it would seem that those who chose to do that “expressly” stand at around 15,000.

Yet , no one commented on the 15,000 voters who chose to spilt their ballot cards, rather than mark them in favour of one of the candidates have bothered to make the point that many of them were breaking the electoral rules. These clearly state that no voter may deface the ballot card or write defamatory remarks about the candidates thereon. The law also provides for heavy sentences for those guilty of such offences.
Many candidates and polling agents were shocked at how low some people could stoop. Many cards carried obscene language, highly libelous of one or both candidates.
In one instance, somebody had gone to great lengths to draw a male penis in the mouth of one male candidate with obscenely suggestive remarks. Vicious allegations also targetted some female candidates. Another candidate, who happens to be bald, had several strands of hair planted on his head.
These were done by people who took several minutes in the polling booths. Obviously, election officials or even the police could not intervene and this could be seen as interfering with the secrecy of the voting process. Voting is supposed to be secret.
The irresponsible ones, were acting at the behest of Wavel Ramkalawan, Ralph Volcere and even supposedly respectable lawyer Philippe Boulle.
It is sad that no action was taken against them. And they are in fact being praised in some quarters. Had they sincerely wished to register their disapproval of the candidates, they could just have ticked twice or put two crosses in the boxes provided for such purposes.
Did they need to use insulting language or even obscene language or drawings?
Yet, history will note that over 68% of those who voted, marked their cards correctly and registered clear votes.
That is more than doubled the percentage of votes “spoilt”, a great majority. The majority of Seychellois have spoken clearly.

Anonymous said...

It is also an offence for divulging informations after swearing the secrecy act. No matter how insulting or obscene people had defaced their ballot papers. No electoral officers had the right to comment on what they saw on the ballot paper. This is simple a matter of principle after one had sworn to the secrecy act.

Anonymous said...

That was an article in The People. The police should get the editor to divulge its source.

Anonymous said...

I think if there is a boycott of the presidential elections, people will be timed in the polling booth, and dragged from the polling booth if they take too long, in case they are writing messages for Michel or Faure.

Reply to all-

At the outset, I hope everyone had an excellent, fantastic weekend and I ask you all to reflect, on how you can live free and achieve best, everything in your life you ever dreamed of.

When you live your dreams, you destroy communism.

This, Seychelles needs badly and we need it fast.

Ramkalawan is using the BOYCOTT to attempt to salvage his dead political career. Note all the comments on the preoccupation with the National Assembly, which I strongly suspect is strongly driven by him.

Seychellois do not give a rats ass about a communist National Assembly.

Our united boycott was made to call up the promises of Democracy and Freedom to Seychelles and her people.

We will hold to this promise the PL !

The opposition must round table discussions and not let the strategy of Ramkalawan guide us into the dark woods ahead.

If he continues this policy of division, we will expose every single blunder he commits to ward off the opposition supporters of dangers ahead.

Alone, Ramkalawan and SNP simply cannot be trusted to make good decisions for us. Just look at what they have done in 18 years and they topped off their cake with a sell outs like Pierre and Carpin as little consolation prizes for us.

Freedom Party was formed to secure three things: 1. Democracy , 2. Freedom, Regime Change.

Freedom Party was not formed, to pension its leadership with 32,000 per month for the rest of the leaders life.

Have a great week and live free!

The fight for Democracy and Freedom against the back drop of a hardened communist culture is not for the light hearted to front.

Those that believe the job is for parliamentarians, as we have heard SNP tell us for 18 years are wrong.

Those that have told us it was for their pockets, and pensions as politicians because they struggle and have nothing to show for it, do not belong in this fight.

Those that say we believe in the Ballot Box have been wrong all along.

Those that said we were in a democracy for 18 years, are of course, 100% wrong.

Why?

1. Because one of the key symptoms of communism at play is to buy out the opponents, no matter how well intentioned they are at the out set.

We have seen this place out with JRM old DP and recently with SNP in tete a tete meetings in 2008 and 2007.

Now Ramkalawan wants a tete a tete with Michel, to restore SNP place in the National Assembly.

I understand the meeting has already taken place in secret.

This battle, that brought us together under BOYCOTT banner, is not a battle for any party in Seychelles.

This battle , that brought us together under BOYCOTT banner, is not a battle for money, salary, perks privileges and position.

This battle is about our people's quest for 1. DEMOCRACY 2. Freedom.
3. Regime Change.

PL and SNP want to fool us and fool us into not knowing what we BOYCOTTED.

They say we Boycotted for reforms in electoral process.

That is just one foot note to why we BOYCOTTED.

For this, what SNP is doing, and what Ramkalawan as its leader is condoning, is nothing short of a disgrace.

Sorry, but we must expose the blunders until it stops.

Too many blunders will cost Seychelles great opportunities. It is for this SPPF PL are happy with SNP as a lead opposition when PDM has failed to garner acceptance by the people.

We in Freedom Party and opposition will not be fooled. We know PL can raise the money to buy sell outs at heart.

Gill seems to have a lot of information on who Michel meets. You obviously think you know more than anyone else. But more than a week after a successful SNP/DP/Boulle boycott, I expect Michel to start making moves to engage the real opposition, after Michel has failed to set up PDM as the opposition. I expect Michel to go to Ramkalawan with his tails between his legs to discuss how to move the country forward. Michel must know that life cannot go on as before, after the boycott. This country needs democratic and electoral reforms followed by fresh elections within a year. Michel must know that he cannot allow 25,000 to get angrier and angrier over the next 5 years with a fake national assembly.

For the last few months we have paid speaker Herminie to do sweet FA. On the other hand, as he has been twiddling his thumb he has not been doing any damage to the country, apart from being a waste of space.

Once sworn in, the assembly's first action is to elect a speaker. It is certain that they will re-elect Herminie, as he is back as one of the 6 proportional members. The hope that Herminie will be back simply to swear in new MNAs is dashed. So more incompetence from the speaker. In En Nouvo Sesel, plus ça change plus c'est la même chose. Parti Lepep has a problem getting shot of its failures.

Potter will no doubt be appointed leader of government business, a post that is nowhere to be found in the constitution. But with a free hand to change the constitution, Parti Lepep can now make Potter's position constitutional.

One thing Parti Lepep will not be able to do is appoint a leader of opposition. They might want to change the constitution and abolish the post instead.

Without the Opposition it will be one of the MOST BORING institutions of the country.

Mr Speaker will be bored to death, he might resign and go back to Ministry of Health to work as a GP.

The police will have less work since they will have no MNA´s of the opposition to beat up.

They might as well open a casino in the New National Assembly building, icluding beds for its mebers since they will all be BORED.

PL is digging in for the long run knowing opposition is fragmented by Ramkalawan.

If SNP and Ramkalawan does not meet at the round table for discussions on the future course of action, we must move on, in spite of their divisional childish games, that one would find only in a playground at primary school or perhaps in the street gang mentality of East L.A.

The national interest of the Nation take precedence over Ramkalawan's personal financial interest and the fight between SNP and PDM and division between them.

I humbly propose, that SNP re engage with Pierre and PDM their fractionalist party born out of the under belly of SNP. Work out your problems and tell Pierre to give back the money he took.

I humbly propose in this context, both parties keep their dirty laundry between themselves.

Finally, I humbly propose that we move on and that discussion be in the context of a round table. Send the driver or the gardener is Ramkalawan is too ashamed to show up. We understand these details in the human spirit and hold him free of guilt.

In the meantime, no Business community should assist the divisional SNP one single rupee. I agree with that. Keep your money for hard times ahead do not invest in division with no plan except a back door meeting with Michel again.

Last time this was done, we had a 38% salary increase and 70% pension for life to pay for, and God only knows what else.

I worry when politicians meet in secret.

Anonymous said...

When ?
Who says ?

Anonymous said...

Chris thinks he can destroy Ramkalawan with his allegations of secret meetings, in the same way that secret meetings at State House destroyed Pierre.

Anonymous said...

The one-party state national assembly restarts its sessions this afternoon, with gorilla Herminie in the chair. His re-election is guaranteed by this feckless bunch of Parti Lepep MNAs. Unlike before, he will get 100% support for his re-election.

There will be more than a tinge of sadness that buddy Pierre is not joining them, marooned in the constitutional court. He will be hoping that his comrades have left the back door of the national assembly unlocked and slightly ajar for him to sneak in in a few days' time like a thief at night.

The great plans of mice and men to invent a bogus, synthetic and pirated opposition have come to nought. Pierre's ambitions were wrecked in the ballot boxes and he has gone to the constitutional court beaks for a salvage operation.

They might as well start their yakking in late afternoon. There will be not a lot for this counterfeit national assembly to do. This assembly will be a constant reminder that Michel's took a massive gamble and failed. Democracy got derailed. It will also be a persistent reminder that Michel has been an incompetent president. If he enjoys this afternoon's spectacle of a perverted democracy on reclaimed land, he is more stupid than he came across on election night on SBC.

Reply to Poor Christopher Gill-

I am just fine and my family is just fine. Thank you for your interest.

If I leave politics alone, go silent, then SNP will become irrelevant to PL.

Georges client,, who is higher then FIU, will walk all over the people of Seychelles, because SNP will be in their pockets. Right Bernard?

Boy this file is getting heavy.Just that move, was a $ 500,000.00 move for Michel.

"If I leave politics alone, go silent, then SNP will become irrelevant to PL."
Please translate this for me. I struggle understanding what you write and what your president reads. It may be the effect of el ninno.

Anonymous said...

Good advice being given to Gill. Take it, Chris. Pass the baton to JPI.

Anonymous said...

On SBC last night Herminie was moaning about the absence of divergent views in his new assembly.
One party yhey wanted, one party they have. He should go and complain to his boss Michel.

Anonymous said...

Reply to "Go Silence"-

This advise seems to be driven by a slave mentality.

I cannot go silent.....it violates my humanity.

Why don't you go silent, and show me how it is done.

As for SNP, they are already irrelevant, because they feel comfortable and not threatened that way.

The round table meeting held yesterday was excellent, and a sense of common goal and bonds are taking shape putting our national interest before political party interest.

In attendance were myself, Boulle, Volcere, Dhanjee and others.SNP did not send even their gardener.

I hope you all are having a wonderful week and living it as free and as happy as you can humanly.

While you are, do not try to reduce another persons humanity in the process of enjoying your life.

Did you guys see the empty seats in the assembly? One is reserved for David Pierre who hopes to join his comrades-in-conspiracy next week.

Anonymous said...

If, as Gill says, the round table is going well, napa laraz. Ramka and SNP are irrelevant. Let's focus on other things.

I hope that this round table does not end up like Mancham's press releases about his overseas trips: a lot of smoke and nothing to show for it.
I hope that this round table can come out with a plan and propose to us a way forward. We do not want to be still sitting round a table this time next year.

Anonymous said...

SNP Pathetic-

Yes the Round Table is going well.

I confirm this.

Yes we are focusing on other things.

I confirm this.

But the file gets bigger and bigger.

This is something we cannot ignore.

I asked you before, now I ask you again, what do you want me to do with this file?

I thank all ex -SNP coming forward with these details for this dubious file.

The BOYCOTT will have notched up a SUCCESS if it makes Parti Lepep MNAs, especially Herminie, reflect on the real meaning of DEMOCRACY and the need to allow the OPPOSITION to SPEAK in the national assembly.

Anonymous said...

Reflecting on democracy does not mean they will change, and why reflect on democracy when they do not even understand its definition?
Forcing Pp to go back to one aprty state is a success,Pp has long garbed itself under the dress of democracy to give interantional donors believe we in a democracy but the boycott has unmasked Pp .Now that Pp is alone in the Assembly taking decision not in the onf the people but the party makes ppmore vulnerable than ever.Do you think when Michel said quote"I should have negiociated with the Oppostion" instead of creating a fake Party,he mean a lot, dito to Hermenie saying i would have like an oppsotion in the Assembly this also speak for itself. It speaks for itself becuase Pp realize Dissolvong the Assembly was a mistake, creating a fake party was a mistake Why?They did not achieve the outcomes expected.Morevoer,Michel objective by dissolving the Assemblyas to gain a passant party that would play the sparing partner of Pp in the ssembly thus give Pp credibility, but after Michel realized that the Boycott would do much more damage than expected he could not even promise Pierre a seat for his own party was in danger thus he was forced to abandone Pierre for his own survival.

The main problem with Herminie is that he is not a democratic speaker. You do not need to be a bully to run the house. He needs to put it in his thick head that in Democracy, the constitution makes provisions for a Leader of the Oposition, and as stated in our supreme law he is to be respected as such.
In all democratic countries the legislative is referred to as Senators, equivalent to MNA in Seychelles, and these politicians nedd to be treated with respect, and not BULLYING them as though he was the only educated person in the house.

Its a great setback for our young democracy that this individual has been re-elected speaker, especially after showing his total incompetence and lack of interpretation fo our Constitution.

Things will get worse since right now in this ONE PARTY STATE NATIONAL ASSEMBLY, there is not even a lawyer and nobody has any knowledge what soever how to interprete the laws of Seychelles. This is just the begining of the biggest FARCE OF THE AFRICAN CONTINENT.

God bless real democracy.
