Elections for Seychellois, or for Michel?


Ben Carson argues that reform in Seychelles may have come too late as Seychellois head to the polls after the dissolution of the National Assembly.

This weekend Seychelles will go to the polls to elect a new National Assembly after President Michel's Parti Lepep led a National Assembly vote to dissolve itself in July this year.
Elections were due to take place in 2012 but the vote means new elections had to be held within 90 days. The dissolution, a sequence of events which began with the idea of reform, were an apparent attempt to make elections more fair and transparent. But the process has ended with a situation where the election may produce a result less representative of political feeling in Seychelles than the presidential elections in May, won by James Michel.
An analysis of this intended electoral reform, and the route to the election, suggests that Seychellois democracy may have instead taken a step backward.

After the presidential election

After the presidential elections in May 2011 it appeared that the newly re-elected President Michel might commit to electoral reform. The presidential elections took place amid allegations of corruption, unfairness and of a lack of transparency. Independent observers made various post-election recommendations. A common theme was the creation of an electoral commission to replace the single electoral commissioner  - although observers were  complimentary about Hendrick Gappy himself.

In his victory speech Michel said:
“In the New Seychelles we shall continue to put in place and strengthen our legal and institutional frameworks to ensure the progress of our democracy. It is my aim to improve on our achievements and to reinforce the rule of law, good governance and transparency.”
This seemed to suggest that Michel was willing to go ahead with reforms and wanted to improve democracy in Seychelles. Of course, talking about change is not enough. Michel's own government launched a Constitutional Reform Committee in 2008 shortly after the last round of elections which promised much and resulted in little. As a consequence the 2011 elections were were characterised by failures similar to those in the 2006 and 2007 elections.
But Michel has moved more quickly this time. Within weeks of the presidential election a new bill was tabled to create an electoral commission. The bill was presented to the National Assembly but rejected by opposition leader Wavel Ramkalawan and his party, the Seychelles National Party (SNP). However, in a dramatic series of events one member of the SNP - Jane Carpin - crossed the floor to give Parti Lepep the 2/3 of the vote it needed to pass the bill. Michel then tried to dissolve the assembly, again using Carpin's vote to get the number of votes required. But dissolution was temporarily delayed by two appeals to the Constitutional Court arguing that a vote for dissolution had to be scheduled in advance of the vote itself so that members of the assembly could make sure they were present to vote. The appeals were upheld, but a subsequent scheduled vote for dissolution still passed, again with Carpin's vote. This happened despite the fact that Ramkalawan tried to have Carpin removed as a member of the assembly on the grounds that she was chosen by the SNP to be one of their proportionally elected seats rather than being directly elected to the assembly.

A closer look at the 6th Amendment Bill 2011

In a detailed  independent observer report the Commonwealth Expert Team elaborated on its recommendation to put in place an electoral commission:
"[O]ur concern is that while [government officials] may very well go through the exercise of establishing such a Commission in fulfilment of our recommendation, the appointees to the Commission must be from a broad cross-section of stakeholders and the appointment process must also be, and be seen to be, a truly independent process."
Whether the appointees to the Commission are "from a broad cross-section of stakeholders" can be questioned. Hendrick Gappy was picked to lead the Commission, and although it will undoubtedly benefit from his experience, a completely fresh start might have been helpful to make sure the appointment process is "seen to be" truly independent. Unfortunately, an in-depth analysis of the independence of each member of the Commission is beyond the scope of this article.
It is important in the long-term to look at how members of the Commission are chosen and whether this is an independent process. This is set out in s.2 (f) of the 6th Amendment Bill 2011 which gives a replacement for Art 115 of the Constitution. The relevant substitute section (S.115 A. (1)) states:
"The Commission shall consist of a Chairperson and four Members all of whom shall be appointed by the President selected from seven candidates … proposed by the Constitutional Appointments Authority …"
The Constitutional Appointments Authority consists of three members, one of whom is chosen by the President and one by the leader of the opposition. Those two members then agree on a chairman - although if no agreement can be made by the members then the president can choose and appoint the chairman himself. It should be apparent that this process gives the president effective control over a majority of appointments to the Constitutional Appointments Authority should he desire it.
The Constitutional Appointments Authority then proposes seven members for the Electoral Commission and the president has a veto over two members (or 30%) of proposed candidates. No veto is given to members of any other party.
From this it seems the process of choosing who will be on the Electoral Commission is compromised at two levels of the selection process, so the substantive reform in the 6th Amendment Bill does not appear to live up to Michel's claims that he will "reinforce the rule of law, good governance and transparency". The reality of reform seems to have been lost along the way.

How the bill came to be passed

It was important to independent observers that the appointment process of the Commission was "seen to be" independent. This ties in with a current problem in Seychelles - the belief that politics is corrupt and a resulting scepticism and fear that reduces democratic legitimacy in the country. We should, therefore, also look at whether the bill is seen to be fair, as well as whether it is fair.
The bill was introduced to the National Assembly and passed with no support from the opposition, except for Carpin. This makes it look like the bill was forced through the assembly rather than passing with unified political will. The lack of support also suggests that a reasonable number of people may think that the bill is unfair. Both of these factors, the apparent force and the lack of support, undermine the image of the bill as fair.
Subsequent political fighting and infighting has also marred perception of the bill. The reaction from Ramkalawan, trying to remove Carpin from the Assembly, and the actions of Carpin herself can both be called into question and serve to make recent events about politics and power rather than substantive reform. Neither the bill, nor the way the bill was made into law, seems to embody a spirit of transparency, good governance, or fairness.

Dissolution of the National Assembly

The content of the 6th Amendment Bill, and the way it came into force, could be excused as merely unfortunate; an example of parties failing to work together effectively and not considering the implications of their actions. At the very least a case could be made that both parties, and individuals such as Carpin, were trying to do what they thought was right in the national interest.
It is more difficult to say the same thing about the dissolution of the assembly.
After succeeding in passing the bill to create a new electoral commission Michel chose to try to dissolve the National Assembly. It is difficult to understand why Michel may have thought dissolving the assembly could be in the national interest.
It could be argued that the Assembly was ineffective due to the SNP's resistance to taking part in the legislative process after the results of the presidential elections which it deemed unfair. However, from Michel's point of view it is still difficult to see why dissolution was the best option for the country. If Michel believes that effectiveness of the Assembly rests in making the laws he believes are right then he should have been content: he could pass laws with his party and the support of Jane Carpin. Perhaps Michel believes it is important to have a rigorous opposition to fuel debate about the laws that are made. But this is a difficult argument to make given that no opposition is adequately prepared to fight an election. Dissolving the Assembly and having an election now will not produce at atmosphere of greater debate. Instead, with the SNP boycotting and several smaller parties likely to split the SNP votes, the Assembly is likely to end up more one-sided than before and with less debate.
So why dissolve the assembly? The obvious answer is in order to win. Michel may have believed that he could guarantee quick and easy victory with a forced election now. A divided opposition has completely collapsed. In its place are several small parties which will fight over and split the votes which would have gone to the SNP, leaving Parti Lepep with a large majority.
The problem with this is not so much the fact that there may have been political reasons at the heart of the decision to dissolve the Assembly. The greater problem is Michel's portrayal of himself as trying to reform the electoral process. How does holding a quick election fit in with Michel's stated desire to reform Seychelles politics into something more democratic, fair and transparent? After elections in 2006 and 2007 Michel promised reform. He failed to deliver. After the presidential elections this year he promised reform and delivered a questionable bill for a new electoral commission. But within days of passing the bill the assembly was dissolved and another election had been forced. Realistically, 90 days is not  enough time for a commission to effectively plan and oversee an election.
The single reform which was put in place has therefore been rendered practically ineffective for the current election, even leaving aside all questions of whether the commission is inherently compromised. Yet again an entire electoral cycle will have passed with no effective electoral reform. It therefore has to be questioned whether Michel wants elections that he runs in to be democratically transparent. By Monday we will have to wait another five years - half a decade, until 2016 - for the people of Seychelles to have another chance to speak.
Calling an election because you may win is not undemocratic. But if Michel thought electoral reforms were important, surely he would make sure they were cemented before the election. If he thought the check provided by an opposition party was important he would allow an opposition time to prepare rather than guaranteeing himself five years with a weaker opposition than he has now. The election may not be entirely undemocratic, but the way it has come about raises questions about whether Michel is sincere in speeches where he presents himself as holding democracy and the national interest above all else. He is a politician, and self interest, perhaps, still comes first.

The people has dissaproved the regime,which means they are expecting from PP radical and speedy change towards democratization of the country,and that not tommorrow ,not in four years until the next election,but now.Oppostion must ensure and continue to pressure the regime to meet those reforms before the next presidential election.We must not give Pp the time to breath,the Oppostion has come out in force after this successful boycott,they will need to keep the unity in order to pressure for immediate reforms.This mean Pp will have to work with the oppostion .only so real and geniune reforms can be achieved.

Michel has taken us into the one party state.

Elections under the current laws and constitution do not represent the will of the majority of the People.

This is the time to press for constitutional reform, electoral reform, democratic reform, social reform. In line with this, we will call on Michel to abandon communist tactics in politics and pay for the damage he has caused us to level the playing field in the process.

Nothing else, unfortunately, is as important to PL now that the one party state status exposes Michel administration like a worse nightmare.

Michel should conduct himself responsibly, and so should the opposition.

The first step in that direction is exposing the Zeeda Party by public communique and the opposition should accept it as such and let Pierre go back to his family business, after he returns the money he took in the name of Democracy falsely.

No need to ask whether I had a good weekend. But I can tell you for nothing that it was great. It got better and better. You know, this En Nouvo Sesel palaver ain't that bad after all. I could learn to like it, if it dishes out more goodies like on Saturday night. Any more Saturday nights like that, we would be positively spoilt (oops !) by En Nouvo Sesel.

In my upbeat mood, I think of the Scottish poet, Robert Burns, like you do. The best laid schemes of mice and men often go awry and leave us nothing but grief and pain, instead of promised joy. Of course I am referring to Michel's and Pierre's schemes.

Or to put it more crudely, their schemes to screw the opposition voters failed and in the wee hours of Sunday they ended up looking like arseholes.

Pierre, Carpin, Nancy -- didn't they all look grim, hideous and vile ? Pierre was reduced to begging shamelessly and hopelessly for a solitary proportional seat which he never got.

The great mathematician turned out to be nothing of the kind, deprived of the protective wings of SNP. He got his decimal points, fractions, multiplication, operations, quotient, common denominator all jumbled up. He pleaded for 0.98 seat which he thought should be rounded up to 1 seat and leader of the opposition. His abacus was no match for the 1996 constitutional amendment that sunk him. The public humiliation of the man who betrayed us was complete. He won't be coming back for more any time soon.

On election night, Michel inadvertently told us what he would have considered a failed boycott -- 3 seats for PDM. So, this is a successful boycott, undisputed.

What's more, the decision to dissolve the national assembly has backfired. Even Parti Lepep is admitting that the situation in the national assembly is worse for them than it was before, because they want to show that there is democracy and opposition in Seychelles.

The opposition strategy should be -- immediate electoral reforms and fresh elections in a climate that the main opposition accepts is fair for free and fair elections. We have Michel on the ropes.

Some reforms like access to SBC do not need the electoral commission or changes in the law. It requires the right people at SBC and freedom for them to work free from political interference. There is no level playing field if only Parti Lepep has access to the country's state-funded mass media. In addition, there must be broadcasting reforms to allow others to broadcast.

The issue of electoral reforms is just one issue the international community can now hold PL accountable to establish satisfactorily.

The second issue, perhaps more important, is the laws in place the work to deny the opposition access to the Public.

This are needs focus and cannot be dismissed.

A final area is the lack of social cohesion in Seychelles, makes it vulnerable to collapse now that we will be heading for a long drawn out economic depression.

All leaders need to sort themselves out. Our problems are just about to get compounded because of the long delays in establishing Democracy and Freedom in Seychelles.

Pierre accused opposition of calumny for the treatment he and his candidates received. He did after all betray us.

But what about the treatment PDM and Parti Lepep gave to the independent candidate. What did she do to them ? They accused her of being an SNP stooge. She turned out to be a genuine independent candidate fighting for women's rights in politics. She did not spend the election night complaining of calumny.

Hopefully, Pierre will now grow up. Fidgeting in his seat on election night on SBC, unable to maintain a dignified posture, he looked like a spoilt brat and not a potential leader of the opposition. He got his just deserts.

Plans for photo opportunities at State House for Michel to introduce his leader of the opposition must now be scrapped. Michel must stop pussy-footing with democracy. He must now get on with the serious business of democratic reforms. If not, he will have himself and his traitors to blame when it all blows up in his face.

The most crucial question, just as/like everybody deplore the SPPF/PL political approach - are we to understand from the Opposition Alliance Statement that Mr Viral Dhanjee because he had wanted to stand as a Presidential Candidate is more important, stronger and better political standing that MRS, SFP and Mr Christopher Gill.

This is not 1991 - 93, for the Opposing faction in Sechelles Seychelles to adopt/take the same stand as they did them and what ensued.

It was that SIROP etc exile/refugee program that had save their "toast and bacon" not a word was mention. Instead they starting developing their Brand of political views - not knowing where they had come and going. They had no foundation. They took to nicking, ansconding and plain stealing ideas from that SIROP etcexile/refugee program and the electorate/greater public and the world watched and saw through sme of them.

If/should they want a proper/radical review of the requests they have made above - the first things is a full review of our National exile/refugee position as far back as 1977. A proper national Commission set up to report. International participation in this process. In accordance with the UN, EU, African Union human rights and refugee/exile rights proper national infrastructures be set up and their adequate share of financial allocation to help/assist then function. Beside what the Commision and Review will recommand.

Among the important changes - we have been underlining that several of Sir James Mancham Ministers - had there been a Military coup d'etat were calling would have supported a Senate.

The fact that we have today a large migrant community in Sechelles Seycelles the need to give those group a direct voice/democratic in the near future.

Mauritius - led the way this year in the form of Mr Paul Beranger to call for a Senate in Mauritius.

Over the past 20 years few of those of you who have stood for Presidential election have call/demanded Justice for the large exile/refugee community some 15,000, their human rights. This is the opportunity to demand that their voting Rights beincluded in the Constitution and the voting rights of all Seychellois residing out of Sechelles Seychelles.

We want to underline - and address the Oppostion Alliance leaders. We are not in 1991 - 93. Alone the fact that what has been written across other platform on the WWW. The practice, view still persist/prevail - you can ignore, you can bury, you can cover up, you can invent.

The SPPF FA Rene people saw your/our wickness and dishonesty and the Oppositon and people were made to pay the price - the state of our nation the past 21 years.

I am normally a harsh critic of Today in Seychelles. I do believe that often they compromise their journalistic integrity when they are obsequious to Parti Lepep.

But I think Today's front page is fine, despite that it shows PL's and PDM's candidates. We can see the rogues' gallery in all its vileness.

The statistics tell the story of this election.

My only complaint is the use of the green colour for PDM. Pierre has been using green and blue to con people. I would have thought yellow would have suited him better.

COI/LA FRANCOPHONIE has expressed concern on number of spoilt votes and asked Parti Lepep and others to reflect on that. It has asked the Electoral Commission to come up with electoral reforms to be debated in the national assembly.

There is no doubt that the piles of spoilt votes will remain in the memory of election observers for a long time.

The boycott pressure is starting.

PROPORTIONATELY ELECTED MEMBERS

1. In this Schedule­

“general election” means a general election under article

79(1);

“political party” means a political party which has

nominated a candidate in a general election.

2. A political party which has nominated one or more

candidates in a general election and has polled in respect

of the candidates in aggregate 10% or more of the votes

cast at the election may nominate a proportionally elected

member for each 10% of the votes polled.

3. For the purposes of this Schedule, the Electoral

Commission shall determine­

(a) Whether a political party may nominate any

proportionately elected member of the National

Assembly; and

(b) if so, the number of proportionately elected

members.

4. A political party which may nominate a proportionately

elected member of the National Assembly shall, within

seven days after the general election, signify in writing to

the Electoral Commission the name of the member and

the Electoral commission shall as soon as is practicable

after receiving all the names of the proportionately

elected members under this Schedule publish the names

in the Gazette.

The 1996 amendment to the constitution is clearer and simpler than the 1993 constitution.

(a) Minimum 10% of votes cast to qualify for proportional seat
(b) 1 seat for for each 10% of votes polled.

Pierre did not get 10% of votes cast.
You have to assume "10% of votes polled" means "10% of votes cast" as it follows from the previous reference to votes cast.

Gappy is absolutely correct. Even for previous elections from 1998, the proportional seats were based on votes cast. In fact it made no difference using valid votes or votes cast, because there were few rejected votes.

Pierre can go back and do the calculations. He is a mathematician after all.

He made another monumental error disputing Gappy's calculations on the night, without checking his facts, He compounded his error by insisting on SBC later that he would get into the national assembly, again before establishing the facts.

In 1993 the old rules in the constitution for proportionately elected seats applied. The calculation was based on valid votes cast. There were 11 seats up for grabs. A formula was used and there were 3 stages to allocate seats.

In the first allocation, only parties with 10% of valid votes qualified for proportional seats. SPPF got 6 and DP got 3. There were 2 seats left.

In the second allocation, parties that polled 8% or more of valid votes qualified for a seat. United Opposition (with 9.7% of valid votes) got 1 seat and Wavel Ramkalawan entered the national assembly on this basis. But there was still one seat left.

The final seat went to DP, because in the first allocation its share of proportional seats was 3.6 and SPPF's share was 6.3. DP had the bigger 'remainder' and got the last seat.

So SPPF 6, DP 4 and UO 1. Ramkalawan had to be stopped in 1998.

This complicated system was abolished when the constitution was amended in 1996. Under the new but simplified version UO would not have received a proportional seat in 1993. The history of Seychelles will have taken a different course.

The attempt to keep Ramkalawan out of the assembly in 1998 is now stopping Pierre from becoming leader of the opposition.

In any case, it was another of SPPF's scheme that failed. Because in the 1998 elections, the UO polled 26% and got 2 proportional seats. But Ramkalawan was elected at St Louis. As DP polled just 12% and got 1 proportional seat, Ramkalawan because leader of the opposition.

The other interesting thing is that if the new rules had applied in 1993, both SPPF and DP would have received 1 seat fewer. They seemed more interested in keeping Ramkalawan out as the then third party, not expecting his support to go up.

The change in 1996 was clearly designed to stop small, fringe parties getting into the national assembly on just a handful of votes. Pierre's PDM falls into this category in 2011. I can't see how the Electoral Commission or the courts can help Pierre get a seat, as the constitution and the reason for the 1996 change are very clear on this point.

The Constitution says "10% of the vote cast is required for a seat".

Gappy would not touch it, to his credit, why would a judge touch it, even if he was paid to?

It does not get any plainer then that.

The only way Michel will have the much desired opposition in the assembly is:

1) democratic, electoral, state media reforms
2) fresh elections

In a way PDM's participation backfired on PL and helped the opposition. The huge piles of spoilt votes have had a psychological impact on everyone including the election observers who are now talking more aggressively about reforms. We know that it was the election observers report after May presidential elections that forced Michel to appoint an electoral commission. Gappy must be glad there is a commission to support him. Otherwise, by now, PL would have pressured him to say he made a mistake on election night and he would have given PDM a seat or two by now.

I think the image of spoilt votes has had a more profound effect than say a 55% turnout. 55% turnout is not unusual in many western democracies. But the level of spoilt votes is highly unusual, that is why it is having a profound effect. PL's two key weapons -- Fear and PDM -- failed them this time.

I read in Today in Seychelles how desperate Pierre is to get into the national assembly on his 3828 votes. He is now arguing that those who did not vote for PDM or PL did not cast a vote.

To me casting a vote, is putting my ballot paper in the ballot box. It is irrelevant whether I voted for one or more candidates or I chose to leave it blank.

Pierre wants Parti Lepep's judges to turn election terminology upside down so that he can be leader of the opposition.

Rene changed the constitution in 1996 to make it more difficult for small opposition parties to get into the national assembly. Pierre polled 7.4% of votes cast that day and 5.5% of total voters on the register. Rene wanted to stop demagogues getting into the national assembly.

For proportional seats, Parti Lepep and PDM want to re-invent the meaning of "votes cast".

I was in an opposition meeting yesterday that was very fruitful and enlightening. Mr. Volcere, Mr. Boulle Mr. Dhanjee and other players were present. Ramkalawan has again not attended these meetings. He is personally bent on excluding SFP and Christopher Gill from any discussions.

It is unfortunate. We are not only developing a culture of cooperation, but it appears that this Opposition Committee which was formed to Boycott the election, is a very positive development, because dialogue is at work to bring men together.

I said to you, that because there is no ongoing dialogue with Ramkalawan, we cannot consider his positions as SFP, and we must do what is in the interest of our country and people and this is our guiding light, not Ramkalawan. In the past, we trusted him and he used that trust to pension himself.

The reality on the ground is that SNP still has 90% of opposition support. The others will have to scrap for the remaining 10%, if they go their own way. So the leadership role belongs to SNP and not supporter-less Gill.

Pierre should be thinking less about the 3828 that voted for him in the absence of SNP but more about the 16,447 who went to vote but refused to support him because they were answering the call of the real opposition to spoil their vote.

Dhanjee is in the same position as Gill. Just businessmen with money and lawyers and no political support to show.

Michel urges electoral commission to speed up reforms. More games. Now he is blaming the body set up in a hurry and given little time to organise elections called in a hurry. He is trying to get some praises from election observers in their final reports, given they have called yet again for reforms.

Our struggle at Freedom Party is about: 1.Democracy, 2. Freedom, 3. Regime change.

In that context, Ramkalawan and SNP have been co-conspirators for 18 years with PL SPPF, giving us the window dressing of a fake democracy in exchange for salaries perks pensions. As much as 32,000 per month pension for life. Most took the pay packet of Sr. 10,000.00 per month, and then joined the BOYCOTT line.

Who said they believed in the Ballot Box?

Who said we have a democracy in Seychelles opposition?

We cannot trust Ramkalawan or SNP leadership to effectively deliver the three points above. They have not done it in 18 years. They will not do it in another 18 year.

They even went into a BOYCOTT dividing the opposition.

In response to that, no business contributor should give them SNP a single cent of support when they come knocking on the door.

Freedom Party does not need 18 years to deliver Freedom and the two other points highlighted.

That is the issue.
