Jack Beck DECISION OF COURT OF APPEAL IN PDM CASE REWRITES THE CONSTITUTION
The decision of the Court of Appeal in the case of the Popular Democratic Movement is devoid of legal justification and totally ignores the key provisions of the Constitution regarding the matter of the case. In this decision, the Judges of the Court of Appeal, JJ Macgregor, Twomey and Fernando, have not interpreted the Constitution as it exists, they have written their own. These Judges have decided that the wording of the Constitutional amendment is not suitable and they have made their own amendment.
In its decision, delivered on December 9, 2011, the Court of Appeal found that the PDM was entitled to a proportionally elected seat in the National Assembly from the result of the general election held on October 1, 2011 because it had obtained over 10% of ‘valid votes’. It thus reversed the majority decision of the Constitutional Court given by CJ Egonda-Ntende and J Gaswaga and of the Seychelles Electoral Commission that the Constitution allocates proportionally elected seats on the basis of total ‘votes cast’ . The decisions of these institutions could have been overturned only with clear Constitutional basis which the Court of Appeal has not been able to provide.
The Constitution makes very clear and specific distinction between the allocation of seats to directly elected members and to proportionally elected members.
Article 78 of the Constitution states without ambiguity that the allocation of proportionally elected seats shall be as “specified in schedule 4”.
This Schedule 4 carries the clear tile “Proportionally Elected Members” and deals only with such members. Thus the Constitution clearly sets different rules for the allocation of these seats. The Judges of the Court of Appeal have no basis for saying that the two must be the same.
This Schedule 4 contains the provision that has been quoted so often and which was the basis of the Judgement of JJ Egonda-Ntende and Gaswaga of the Constitutional Court.
“A political party which has nominated one or more candidates in a general election and has polled in respect of the candidates in aggregates 10% or more of the votes cast at the election may nominate a proportionally elected member for each 10% of the vote polled. “
As the two judges of the Constitutional Court stated in their decision, the Constitution has in several instances used the terms ‘votes cast’ and ‘valid votes’ and it is clear that there are two different meanings. ‘Votes cast’ as stated in Schedule 4 is different from ‘valid votes’.
Votes cast can only mean votes that are put in the box. As CJ Egonda-Ntende stated, this is the only possible interpretation. The action of casting the vote comes before any interpretation of the vote as being valid or not. If a vote is invalid, it does not alter the fact that it has been cast.
CAJ Fernando’s statement argues that the Constitution could not have intended to recognise that a person would not vote or would cast an invalid vote. But this is precisely what Schedule 4 does.
The principle of using total ‘votes cast’ may be misguided. If this is so, then we have to go back and change the Constitution. The Judges have no right to ignore what the Constitution says.
The Judges of the Court of Appeal have fallen back, as Judge Burhan did in the Constitutional Court Case, on the Elections Act, which prescribes a different method of tallying the votes. But it is very clear that the Elections Act does not apply to Proportionally Elected Seats.
This is how the Elections Act begins:
Short title and Application 1. (1) This Act may be cited as the Elections Act.
(2) This Act shall apply for the purposes of: -
(a) an election of the President
(b) an election of a directly elected member of the National Assembly
(c) a referendum.
The Act does not include ‘Proportionally Elected Members’ in its stated purpose and makes no mention of proportionally elected seats. In seeking to rest their judgement on it, the Judges are grasping thin air.

Last week I focused on the state of our country with all the difficulties we are currently going through. It looks as if every day there is something new that confirms that our country is in free fall. Take the news on the SBC last night informing us that there is only one chicken farmer left rearing his last 5000 chickens. Talk of food security!
Let us now turn to our institutions that are supposed to uphold our democracy and society. This year has been one whereby we have seen many cracks and weaknesses in very important ones.
Take for example the Constitutional Court where judges of the Supreme Court sit. Twice this year we have seen their rulings regarding political cases thrown out. The first was the case of Viral Dhanjee where he claimed that his rights had been abused when the Electoral Commissioner rejected his papers. He won his case only to see the very decision quashed by the Court of Appeal.
The second one was the PDM case regarding proportional representation according to schedule 4 of the Constitution. This was a case of interpreting the Constitution. The Constitutional Court ruled one way and the Court of Appeal in another. Who can we trust and believe in? Or is it now a question of the people having lost confidence in the judicial system?
Interestingly we now have a case before the Supreme Court based on a complaint of a Court of Appeal judge where she will be a witness! All this is simply pathetic, because if she is not happy with the decision she will appeal to her own court! And what about the judge who will deliver the judgement and the lawyer who will cross-examine her? In what light will they be viewed by that judge in her court? Does this not call for her resignation?
The National Assembly as one of the three pillars of our democracy showed big weaknesses of its own. In the first place we saw a member betraying her party being applauded by the ruling party and going on to vote for the dissolution of the Assembly.
The dissolution was ruled to be unconstitutional by the Constitutional Court. When an institution that has as main role to uphold the Constitution and be the legislative arm of our state, messes up at this level, again confidence drops.
After the October election, we ended up with a one-party Assembly - another indication of going backwards. Now that the court has amended the Constitution we have ended up with a situation whereby the Leader of the Opposition will not be elected as the Constitution indicates, but will rather be nominated by the Speaker. But furthermore it will be a leader who represents not the opposition, but his own party as the boycott indicated. While he scored some 3000 votes, spoilt ballots amounted to over 16,000! What a mess!
Another development makes one ask questions as to what is happening in our country. Now that the Court of Appeal has changed the way of determining PR seats, the Electoral Commission has openly expressed its disappointment. So we have the Electoral Commission versus the Court of Appeal. When the Commission then invites the Parti Lepep to name two other members, they refuse! Is that an indication that even the ruling party is not happy with the decision of the Court of Appeal?
Another institution that has given itself a bad name is the police. We count on that force for security. When officers of that body act as thugs, then it has failed. This was clearly shown on the SBC on Wednesday night when they caught a police officer firing pepper gas at a crowd of innocent people, including children and the elderly, then running away. We all await the outcome of this case and see whether the officer in question will be sacked and charged. Back in 2006 officers who acted like thugs were actually given a promotion!
Our primary institutions are in a mess. Without strong and credible institutions we will continue on the downward slippery slope. We cannot build a country this way. This calls for a change. God knows how badly we need it.

And talking about free fall, first it was Boulle, then Volcere and now comments by Wavel Ramkalawan attacking the Judges that are the Guardians of our third pillar of our democracy at their own perils.
I therefore nominate Monsieur Pissed-Off to start advising all those in the Opposition with some sound advice once and for all.
Our ROTTEN courts and their ROTTEN judges and justices are being justly criticised. They need to mend their bad old ways. We must get rid of the scoundrels who are there to miscarry justice in order to give Parti Lepep the decisions that it wants.
As for the itinerant and errant so-called justice Twomeny, it is my view that she is out for personal vengeance against the Weekly editor. She wants to see Volcere hanged, drawn and quartered (failing that, transported to Ireland) for having the audacity to ruffle her bed of roses courtesy of Parti Lepep.

Our judiciary must be independent,that is.It is the ability of each judge to decide each case according to an objective evalution and application of the law,without the influence of outside factors.
But it has also to do in the way appointing and re-appointing judges is done.For instance,screening of applicants by an independent commission,then confirm by Assembly in a method of merit selection and accoutability among many over things.
Our country need a clean sweep from corruption,cronysm,patronage and so in order to fix our crumble institutions.The ultimate solution is to get rid of the cuases of all those mal-practices namely Pp one party communsit system.

Wavel Ramkalawan mentions the plight of lawyers defending Ralph Volcere who will then appear in cases at the Court of Appeal before Twomey. Don't forget Duncan Gaswaga. If he finds against Twomey, Twomey will get great pleasure in over-turning his judgements in future. Because of that woman, we get a reminder that the whole judiciary cannot be relied on for justice. Twomey's rash action is an attempt to intimidate editors of the free press, lawyers who defend Twomey's victims and judges who dare rule against her in a lower court.
In Ireland, there would have been a public outcry for her resignation. She would have resigned by now, spending Christmas ruing her inability to act like an upright judge should be. The rhetoric, slander and threats are indicative of the small minded begrudging mentality so pervasive in Seychelles today. I can only imagine the morass the country would find itself in should any of you find yourselves within a whiff of power. I'd imagine that people might even become nostalgic when looking back at the era of the one party state and what followed.

Where's the slander ? Saying that Parti Lepep judges are corrupt ? It would be naive to assume otherwise, in the absence of evidence that a judge is not corrupt.

You see Gill, you are talking about 'crimes against humanity' not 'genocide'. Get it right ! But as I have said many times on Seychelles Reality and STAR, the ICC will not go back before 2002.
Neither you nor Gary Tall had any idea what you were doing with that letter to ICC. But I understand the frustration of seeing Rene getting away with murder. The solution lies within Seychelles -- a new government prepared to prosecute the culprits. These crimes are crimes in Seychelles and will always be crimes that can be prosecuted in Seychelles.
Stop dividing the opposition so that a new government can bring the criminals at large to justice.
This is tragic to our democracy.
DIRTY TACTICS TO GET DAVID PIERRE INTO THE ASSEMBLY
We have been receiving highly credible information that Parti Lepep are reverting to dirty tactics to get David Pierre and the PDM into the National Assembly. Pressure is being exerted on the panel of judges to overrule the decision of the Constitutional Court that ruled against the eligibility of the PDM for a proportional seat in the Assembly based on the results of the boycotted assembly elections.
In a last ditch attempt to get PDM to the assembly and add some credibility to the single party assembly, the government of James Michel has the support of the Attorney General. Mr Ronny Govinden has shifted his allegiance from the State to connive with government in supporting Parti Lepep, and has distanced himself from the Chairman of the Electoral Commission who has been forced to resort to seeking legal representation from another lawyer. This is tragic to our democracy.
The most troubling aspect of this sad episode that is being played out lies with the panel of judges of the Court of Appeal. The chairman, Mr Francis MacGregor, himself a former speaker of the Assembly and Central Committee member of Parti Lepep, is still active in his support of the party. Only two weeks back, we published a letter he sent to the Constitutional Appointments Authority where he has attempted to influence their decision in appointing the controversial Judge Domah to the Appeals Court for a second tenure. Judge MacGregor will waste no effort to submit to his political masters in reversing the ruling of the Constitutional Court.

Furthermore, MacGregor was one of the lawyers together with Albert Rene, William Herminie and France Bonte during the drafting of the present Constitution. He was also a Central Committee member of the SPPF and former post of the caucus that would determine the amendment in 1996. As speaker of the National Assembly in 1996, he presided over the approval of the same constitutional amendment bill.
Will he now be the one to undo all he has tirelessly fought for ? The second member of the panel happens to be the sister of the former Secretary of State and currently consultant to James Michel, Mr Alain Butler-Payette. Mrs Mathilda Twomey is a Seychelloise residing in Ireland and was appointed to the Appeals Court by James Michel early this year. With the full support of her brother, she has been appointed and hired as a foreign judge with all the perks that are accorded to foreign judges, it is alleged.
This includes accommodation, free passage and a hefty allowance paid in foreign exchange. We hope that she will not find it very difficult to rule against the wishes of the ruling party.
The third and last member of the panel is Judge Fernando, who is much respected and maintains the respect of the judicial community.
Words have already been leaking through the legal community about the maneuvers to overrule the decision of the Constitutional Court and not everybody is happy.
There is serious concern that if the Appeals Court overturn the ruling of the Constitutional Court of which the Chief Justice was the chairman, the judiciary will lose all the limited credibility it had gained and the whole system turned into a joke.
Parti Lepep will stop at nothing to undermine the authority of the courts to retain power and deny the people of the Seychelles the reforms that are badly needed. Having failed to get their surrogate political ally to the assembly through the massive use of money, they are now determined to achieve it through the undermining of the courts.
This is too dangerous a situation that the people of Seychelles should keep in check. We shall not allow the government to order the court as they wish.

The definition of GENOCIDE under the Convention fits squarely on the SPPF regime, the systematic pattern of political murders of opponents of the communist regime in Seychelles.The opponents of this regime are/were part of a national group that was systematically murdered, tortured, victimized throughout the one party state and onwards in the faint multi-party era, which has been exposed to be a fake democracy to shield the same rogue regime.
The list of those murdered, submitted by SFP Ambassador Gary Tall, is a "preliminary list". It is not exhaustive. We will continue to add to it. For we know that many families, were paid to remain silent on the loss of their family by the perpetrators themselves.
As the list grows, we will all come to know what really happened in Seychelles from 1977 onwards concerning these brutal and senseless killings.

I agree there was political cleansing. That is not one of the international crimes for the UN and ICC to deal with.
I do not agree there was genocide.
I agree there were crimes against humanity but there was no international law to deal with them. As I have said, the ICC can now deal with crimes against humanity but only from 2002.
You will recall or have learnt from history lessons that there were no international laws to deal with crimes against humanity (Soweto etc) under South Africa's apartheid regime.
Don't you think that Castro's regime has killed many Cubans that opposed him ? What about the introduction of Communism in China ? What about the USSR ?
Until 2002 and ICC, these leaders were not breaking any international laws.
The UN can set up UN Tribunals for heinous crimes that affront humanity. But you will need to convince the UN to set up a UN Tribunal. My personal view is that the UN will not see these murders/disappearances as worth their time to get involved in a member state's affairs.
The UN does have double standards because, after all, the UN are its members which include Seychelles and which set the rules as it suits them.
There were times when a majority of UN member countries were applauding Rene's regime. But times have since changed and so has the UN.
As your brother keeps saying, you cannot rely on international organisations. It is up to the people of Seychelles to take action.
If you want to involve the ICC, then you must be clear what the ICC can do and how it works.
If you want to involve the UN, then you must be clear what options and mechanisms, e.g. setting up Tribunals, are available to the UN and who are the powerbrokers. China has a veto at the UN. Will you get China to approve any UN resolution to investigate the crimes and human rights abuses of Albert Rene and Parti Lepep ?
Rather than calling me names, you should accept your mistake in writing to ICC, stop pulling stunts, learn from what I have written on these two blogs to see how the families of Rene's victims can get justice. Compounded with the fact that we are a micro state, and political cleansing took place which is not unlike ethnic cleansing in this period, I see no reason why the UN will not apply the definition of Genocide to their investigations.
In fact, being a micro state, they will give Seychelles more attention then you think, since they do not want to isolate small states and make them feel left out when it comes to justice being done.
While we are a micro state, 90% of all ship traffic goes through our 1.2 million square kilometers of territorial seas. I do not see Seychelles as a weak player in the World. We are only as weak as our leadership intellectually and our opposition for the same reasons.

Let the UN do what it does. They can investigate, prosecute, or simply say there is not enough evidence to move forward, or they can charge lessor crimes on the culprits if they like.

One important center of Collaborator power is international legitimacy. This is going to be an honest review after a gastly start to the last leg of our honeymoon. On arrival the staff had no idea who we werer or why we werer there despite hving booked the 7 day stay 6 months in advance. Now what the staff were trying to cover up was a party of over 30 "ladies" with a bunch of rich arabs - royalty from one of the arab states who had just arrived the day before. Frankly the last thing my wife and i wanetd to see were those sorts of "ladies" - not leaset 3 to a man partying in what was meant to be one of the most luxurious, private and excluisive romatic resorts in the seychelles. Nontheless - the staff rallyed - they tried to apologise for their administration mistake that had us arriving the following day - however NO flights from Joberg arrived the following day - the flight schedule had changed - i guess this showed the slight lack of any organisation.
We got checked into our magnificient room and suite by 1am and we fell asleep - the room, bed, sheets, 2 pools etc cant be faulted. In the morning the 2 or 3 managers plus our butler arrived to try and make up for the fiasco from the night before - they told us they dont normally have those types of guests but the Arabs are very good clients and they have them segregated in a separate part of the hotel complex so no guests would normally see the "party". In fact the manager did make up for it and paid for a private charter boat for the day for just my wife and i - our butler couldnt have been friendlier - although to be honest i found it a pain having to call for him every time we needed something, and the mimi bar was badly stocked and very expensive.
The beach and ocean uinfron of the hotel is nice, lots of sea life but not nearly as beautiful as other places we visited in Le Digne and Praslin. Overall i actually left Maia feeling slightly ripped off and disapointed, i wish we had staying on Praslin or gone the full distance and stayed on one of the more remote islands. Mahe just isnt that attractive, and Maia has the most amazing Spa, and the rooms are great but honestly thats about it. The food isnt that special, and the restaurant is limited, and the pool next to the main restarant just isnt private enough to relax as its opposite the only restaurant. One more thing - all food in the rooms has to be cooked in the kitchen then carted up to the room on a golf cart so by the time you sit down to eat it was often cold or not good.
Do yourself a favor and dont waste yoru money on this hotel - it promises alot and doesnt deliver
