The decision of the Court of Appeal in the case of the Popular Democratic Movement is devoid of legal justification and totally ignores the key provisions of the Constitution regarding the matter of the case. In this decision, the Judges of the Court of Appeal, JJ Macgregor, Twomey and Fernando, have not interpreted the Constitution as it exists, they have written their own. These Judges have decided that the wording of the Constitutional amendment is not suitable and they have made their own amendment.
In its decision, delivered on December 9, 2011, the Court of Appeal found that the PDM was entitled to a proportionally elected seat in the National Assembly from the result of the general election held on October 1, 2011 because it had obtained over 10% of ‘valid votes’. It thus reversed the majority decision of the Constitutional Court given by CJ Egonda-Ntende and J Gaswaga and of the Seychelles Electoral Commission that the Constitution allocates proportionally elected seats on the basis of total ‘votes cast’ . The decisions of these institutions could have been overturned only with clear Constitutional basis which the Court of Appeal has not been able to provide.
The Constitution makes very clear and specific distinction between the allocation of seats to directly elected members and to proportionally elected members.
Article 78 of the Constitution states without ambiguity that the allocation of proportionally elected seats shall be as “specified in schedule 4”.
This Schedule 4 carries the clear tile “Proportionally Elected Members” and deals only with such members. Thus the Constitution clearly sets different rules for the allocation of these seats. The Judges of the Court of Appeal have no basis for saying that the two must be the same.
This Schedule 4 contains the provision that has been quoted so often and which was the basis of the Judgement of JJ Egonda-Ntende and Gaswaga of the Constitutional Court.
“A political party which has nominated one or more candidates in a general election and has polled in respect of the candidates in aggregates 10% or more of the votes cast at the election may nominate a proportionally elected member for each 10% of the vote polled. “
As the two judges of the Constitutional Court stated in their decision, the Constitution has in several instances used the terms ‘votes cast’ and ‘valid votes’ and it is clear that there are two different meanings. ‘Votes cast’ as stated in Schedule 4 is different from ‘valid votes’.
Votes cast can only mean votes that are put in the box. As CJ Egonda-Ntende stated, this is the only possible interpretation. The action of casting the vote comes before any interpretation of the vote as being valid or not. If a vote is invalid, it does not alter the fact that it has been cast.
CAJ Fernando’s statement argues that the Constitution could not have intended to recognise that a person would not vote or would cast an invalid vote. But this is precisely what Schedule 4 does.
The principle of using total ‘votes cast’ may be misguided. If this is so, then we have to go back and change the Constitution. The Judges have no right to ignore what the Constitution says.
The Judges of the Court of Appeal have fallen back, as Judge Burhan did in the Constitutional Court Case, on the Elections Act, which prescribes a different method of tallying the votes. But it is very clear that the Elections Act does not apply to Proportionally Elected Seats.
This is how the Elections Act begins:
Short title and Application 1. (1) This Act may be cited as the Elections Act.
(2) This Act shall apply for the purposes of: -
(a) an election of the President
(b) an election of a directly elected member of the National Assembly
(c) a referendum.
The Act does not include ‘Proportionally Elected Members’ in its stated purpose and makes no mention of proportionally elected seats. In seeking to rest their judgement on it, the Judges are grasping thin air.
The decision of the Court of Appeal, being so weak in legal justification, undermines the credibility of the Judiciary as the guardian of the Constitution and the law. The decision has grave consequences for our democratic system because it allows the composition of a National Assembly that is not according to the Constitution and by that sets aside the wishes of the electorate.

If the beaks close ranks and the Supreme Court jails Ralph Volcere, the whole judiciary will be forever disgraced. There is enough in that case to convince us of a collusion between the executive and the judiciary, hence lack of independence for the judiciary. Twomey chose not o challenge the accuracy of the report in Seychelles but instead miserably chose to say that the article was designed to influence her decision in the PDM case. Been waiting for James Michel's response to David Pierre's call for the resumption of high level talks. According to WikiLeaks, Michel started these talks after the US Ambassador asked him to talk to the opposition and sort out the sham democracy. It remains to be seen what is Michel's incentive this time around, apart from pretending that Pierre is the opposition and Michel is engaging with the opposition. Like the beleaguered Air Seychelles, Pierre too has done his own repositioning. He is trying to show that he is not Ramkalawan after he was not asked to be the vice presidential nominee in the last presidential elections. In short, Pierre is driven by spite for Ramkalawan and pure political opportunism. That is why he has been warmly welcomed by Parti Lepep as one of them. We must be prepared for more friendly overtures by Parti Lepep towards Pierre in the new year. It will all be done to spite Ramkalawan and the real opposition. It is also a recognition that Pierre is not the real opposition but a stooge for Parti Lepep. Perhaps that is why Michel is taking his time to respond to Pierre's cheeky calls for high level talks. Michel must realise that he can fool a lot of the Seychellois people but there is no point fooling himself. Michel is dumb but not that dumb.
PDM is purely a vehicle to promote Pierre's personal interests and enrichment. His other 24 candidates are hoping that Pierre will throw some crumbs at them at the very least. At his hastily arranged swearing-in, Pierre did not spell out his policies. He has just promised Parti Lepep a lovey-dovey relationship while pretending to represent the opposition.
Will they give moral renaissance a break in 2012 ? Or will they keep lecturing us on moral values, while Parti Lepep keeps engaging in unscrupulous and depraved activities in full view of the Seychellois nation ?
As far as little me is concerned, Ramkalawan should have kept his word and withdrawn from politics as he said he would.

Yes. I agree. A people usually gets the leaders they deserve.

Francis Gill got it spot on. Seychelloise must start by engaging in non-violent passive resistance and this is what the so call popular opposition of SNP should be doing. Instead of taking part in senseless meeting with LEPEP which have resulted in nothing tangible apart from their big salary which I personally think has resulted in all the betrayals we have seen in the Seychelles politic. The opposition should pursuit this path. DUBAI, United Arab Emirates (AP) — The United Arab Emirates is revoking the citizenship of six naturalized citizens for actions the government says posed a threat to national security.
State news agency WAM said on Thursday the order to revoke the men's citizenship was issued by President Sheik Khalifa bin Zayed Al Nahyan earlier this month. The men were granted Emirati citizenship between 1976 and 1986.
The news agency says the six threatened the Gulf nation's national security "through their connection with suspicious regional and international organizations and personalities."
It didn't provide details or say where the men originally came from.
Officials at the naturalization and residency office couldn't immediately be reached for comment.

In a way the justices at the Court of Appeal have used the same Parti Lepep trick. Decide what to do first (decide in favour of PDM and Parti Lepep) and then look for justification.

When Mathilda Twomey returns to the Court of Appeal, she will be a much diminished so-called justice, from what we now know about her, from her decision in David Pierre's case, the Weekly article and her decision to connive with the Attorney General to have Volcere jailed. Twomey will not be in a position to lecture anyone in how they should conduct themselves in court, as she did last time when MacGregor's impartiality was questioned. She now has her own dirty linen out in public.
What are we to make of the Court of Appeal ? The President of the Court, Francis MacGregor, is so compromised by his past and unsuitability as an impartial judge, that the way the court works has to change to accommodate him. In the Pierre's case, he did not even given his judgement, apart from concurring, in what Seychelles Nation has billed as a case that effects the constitution and our laws. MacGregor recognised that his background disqualified him from voicing his own opinions. In any case, he did not need to step in to swing the decision in favour of Parti Lepep. He knew that Twomey and Fernando were doing that. In a previous case, 5 justices instead of 3 had to judge a case because MacGregor's decision to sit on the case was questioned. MacGregor's credibility in politically sensitive cases is nil.
Domah should have left with honour after his 7-year contract ended, as stipulated in the constitution. Instead he decided to stay to seek favours from Parti Lepep for a re-appointment. They still expect us to think that they will judge politically sensitive cases without favour, given Parti Lepep's habits of appointing judges that they can rely on to swing judgements in their favour. Are they super-human, extra-terrestrial beings ? It would appear so.
With Twomey now embroiled in controversies that undermine her credibility and ability to be impartial and Fernando a former Attorney General serving Parti Lepep faithfully, what sort of institution is the Court of Appeal. Comparisions with Al Capone's The Mob will not be unfair.
The Constitutional Court (case -- Dhanjee challenging Domah's re-appointment) and Supreme Court (Volcere) can protest they are courts of justice as much as they want. They know they must reach the only decision that matters -- the decision that will please Parti Lepep. Who are they kidding ? Should they attempt to dispense justice and go against Parti Lepep's wishes, they know that they will be struck down by the Court of Appeal where The Mob will tolerate no deviation.

You have a legitimate point. What is our strategy and what do we want to accomplish?
The second question first. We Seselwa Rasin who are not collaborators agree on one thing. We want a genuine democracy in our motherland? We do not want a sham democracy that we have now. So we all in the opposition need to set aside our differences and past grievances that we may have against another and do what needs to be done to bring genuine democracy to our motherland. So that's the goal - genuine democracy.
That does not mean we do not have other goals such as to bring all the Collaborators who have murdered their own people and stolen our patrimony to justice for their crimes. Those and other goals exist. But putting in place a genuine democracy is paramount.
With a genuine democracy, we will remove the Pp Collaborators from power. That is why they have spent so much time and effort to avoid one.
Part II:
So what is the strategy to accomplish genuine democracy in our motherland? Do we start arming ourselves and launch an armed revolution? Then take over some outer islands and slowly advance to the inner islands destroying the economic and social infrastructure of the country and wear down the Collaborators over a long period of time? We can. We have access to weapons in Somalia and elsewhere and we have people willing to lead it and to participate in such a revolution and we can raise the money to do it.
Or, do we engage in a non-violent struggle that will first require mobilizing the Seselwa Rasin people to non-violently struggle to implement genuine democracy in our motherland? I submit that the non-violent way is the way to go unless and until we are violently and brutally repressed in expressing our rights non-violently.
So how do we do this non-violently against people like the Pp Collaborators who rely on brute force to hold on to power. There are several steps. The first is to do what Christopher has done and is doing. We need to show the Seselwa Rasin people the true face of the Pp Collaborators. A lot of people have been doing the same thing here and elsewhere. We must continue this effort to expose the PP Collaborators.
The Pp Collaborators have numerous strategies or centers of power that keep their illegitimate regime in power. We must identify these sources of power and develop non-violent strategies to systematically break them down and remove them as means of support for Collaborator power.
Essentially, we should not use violence against another Seselwa Rasin for any reason unless it is an absolutely last resort. This is part of the Sesel Pou Seselwa ideolgy which is the founding principle of our nation.
The most important source of power of the Pp Collaborators is concealment of their true characters and actions from the Seselwa Rasin people and from the international community.
They need to conceal what they are really doing from the people so that the people do not revolt against them. They need to conceal what and who they are from the international community so they continue to receive aid and other favorable treatment which they use to pay their supporters to keep power.
So we must show the Seselwa Rasin people how the Pp Collaborators are selling us out to foreigners and Fabrike and we must show the international community that the Pp Collaborators have established a sham democracy to hoodwink them into giving them assistance and legitimacy.
The Pp Collaborators will use any means at their disposal to intimidate us from disclosing who they are and what they are doing. They have restricted opposition access to radio and television. They have used bribery. They have used physical intimidation. They have used legal process as intimidation. They will use anything. But despite that we have disclosed who they are and what they are here and in other places. All of us have. And we are continuing to do so.
This effort by all of us is critical and must continue. We must all do whatever we can, writing here, t-shirts bumper stickers flags poems songs etc.. to expose who the Pp Collaborators are and what they are doing.
We have also exposed the Collaborators' sham democracy through the boycott. This is one instance where we all worked together to accomplish an important end.
What must we do from here? We must expose the judicial system for what it is - an extension of the Pp Collaborator sham democracy. We must all do what we can in whatever way to expose the illegitimate actions of the Collaborators and we must prepare ourselves for the upcoming protests which must occur when we are all united in one goal - working together to establish a genuine democracy in our motherland.
Part III:
Above all we must all adopt a Sesel Pou Seselwa mentality - that our patrimony is ours. It does not belong to any one of us or any group of us, but to all us Seselwa Rasin. We must develop the mentality that our leaders are merely the trustees of our patrimony who hold it in trust for all our benefit and does not belong solely to them or their supporters. That we must defend this idea with whatever means we have at our disposal.
